AN ACT 1 Authorizing a grant program for Type 1 diabetics; providing for 2 powers and duties of the Department of Health; and making an 3 appropriation. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Juvenile 8 Diabetics Grant Act. 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 "Department." The Department of Health of the Commonwealth. 14 "Master Settlement Agreement." The settlement agreement and 15 related documents entered into on November 23, 1998, by the
1 Commonwealth and leading United States tobacco product 2 manufacturers and approved by the court in Commonwealth v. 3 Philip Morris, April Term 1997, No.2443 (C.P. Philadelphia 4 County), on January 13, 1999. 5 "Type 1 diabetic." A person from birth to 18 years of age 6 who has been diagnosed with Type 1 diabetes. 7 Section 3. Payment for Type 1 diabetics. 8 (a) Grants authorized.--The department shall utilize a 9 portion of the tobacco Master Settlement Agreement funds to 10 provide grants to Type 1 diabetics as provided in this section. 11 (b) Eligibility.--A Type 1 diabetic shall be eligible for a 12 grant for diabetic treatments and equipment if the diabetic: 13 (1) does not have health insurance; or 14 (2) is not covered by Medicaid, the Children's Health 15 Insurance Program under Article XXIII of the act of May 17, 16 1921 (P.L.682, No.284), known as The Insurance Company Law of 17 1921, or a health insurance plan, that provides coverage for 18 the treatment or equipment, including, but not limited to, 19 insulin pumps. 20 (c) Amount of grants.--The amount of each grant awarded 21 under this act shall be equal to the cost of diabetic treatment 22 and equipment, including, but not limited to, insulin pumps, not 23 covered by the grant recipient's health insurance plan, provided 24 that no grant shall be in excess of $2,500. 25 (d) Regulations.--The department shall administer this 26 section and shall promulgate rules, regulations and standards 27 for its proper enforcement and administration. 28 Section 4. Appropriation. 29 The sum of $3,000,000 is hereby appropriated to the 30 Department of Health from the moneys received by the 20030H0261B0299 - 2 -
1 Commonwealth from the Master Settlement Agreement for the fiscal 2 year July 1, 2003, to June 30, 2004, for the purpose of awarding 3 grants to Type 1 diabetics in accordance with this act. This 4 appropriation shall be a continuing appropriation and shall not 5 lapse at the end of the fiscal year. 6 Section 5. Effective date. 7 This act shall take effect immediately.
