                                     AN ACT

     1  Amending Title 74 (Transportation) of the Pennsylvania
     2     Consolidated Statutes, further providing for supplemental
     3     public transportation assistance funding.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1310.1(a) of Title 74 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1310.1.  Supplemental public transportation assistance
     9             funding.
    10     (a)  General rule.--[Beginning July 1, 1997,] An amount equal
    11  to 1.22% of the money collected from the tax imposed under
    12  Article II of the act of March 4, 1971 (P.L.6, No.2), known as
    13  the Tax Reform Code of 1971, [up to a maximum of $75,000,000,]
    14  shall be deposited in the Supplemental Public Transportation
    15  Account, which is established in the State Treasury. Within 30
    16  days of the close of a calendar month, 1.22% of the taxes


     1  received in the prior calendar month shall be transferred to the
     2  account. [No funds in excess of $75,000,000 may be transferred
     3  to the account in any one fiscal year.] The money in the account
     4  shall be used by the department for supplemental public
     5  transportation assistance, to be distributed under this section.
     6  Transit entities may use supplemental assistance moneys for any
     7  of the purposes enumerated in section 1311 (relating to use of
     8  funds distributed). In addition to those enumerated purposes,
     9  Class 1, 2 and 3 transit entities also may use the base
    10  supplemental assistance share for general operations. Class 4
    11  transit entities may use all supplemental assistance moneys for
    12  general operations.
