        INTRODUCED BY BRIGHTBILL, M. WHITE, STOUT, WENGER, TOMLINSON,
           RHOADES, CORMAN, THOMPSON, MOWERY, CONTI, ROBBINS, ERICKSON,
           COSTA, MUSTO, ORIE, BOSCOLA AND LEMMOND, OCTOBER 1, 2002

        REFERRED TO JUDICIARY, OCTOBER 1, 2002

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense
     3     relating to lie detector tests.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7321(b) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7321.  Lie detector tests.
     9     * * *
    10     (b)  Exception.--The provisions of subsection (a) of this
    11  section shall not apply to employees or other individuals:
    12         (1)  in the field of public law enforcement [or];
    13         (2)  who dispense or have access to narcotics or
    14     dangerous drugs[.]; or
    15         (3)  whose function it is to protect facilities,
    16     materials, operations or assets engaged in the production of
    17     nuclear power, including the shipment or storage of
    18     radioactive or other toxic waste materials.

     1     Section 2.  This act shall take effect in 60 days.
