                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, providing for retirement
     3     eligibility.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 24 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8314.  Eligibility for retirement.
     9     (a)  General rule.--A member shall be entitled to receive a
    10  maximum single life annuity calculated pursuant to section 8342
    11  (relating to maximum single life annuity) without any reduction
    12  by virtue of an effective date of retirement which is under the
    13  superannuation age, if the member meets the requirements set
    14  forth in subsection (b).
    15     (b)  Requirements.--The entitlement provided under subsection
    16  (a) shall be applicable to any eligible member, who, on or after
    17  the effective date of this section:
    18         (1)  has credit for at least 30 eligibility points;

     1         (2)  terminates school service; and
     2         (3)  files an application for an annuity with an
     3     effective date of retirement after the completion of the
     4     school term but in no case earlier than May 15 nor later than
     5     the ensuing July 30.
     6     (c)  Definitions.--As used in this section, "school term"
     7  either shall have the meaning assigned to it in section 102(3)
     8  of the act of March 10, 1949 (P.L.30, No.14), known as the
     9  Public School Code of 1949, as it relates to school entities, or
    10  shall mean the calendar of academic terms or semesters published
    11  in the catalog of an institution of higher education any of
    12  whose employees is subject to membership in the retirement
    13  system.
    14     Section 2.  Title 71 is amended by adding a section to read:
    15  § 5308.3.  Eligibility for limited early retirement.
    16     (a)  General rule.--A member shall be entitled to receive a
    17  maximum single life annuity calculated pursuant to section 5702
    18  (relating to maximum single life annuity) without any reduction
    19  by virtue of an effective date of retirement which is under the
    20  superannuation age, if the member meets the requirements set
    21  forth in subsection (b).
    22     (b)  Requirements.--The entitlement provided under subsection
    23  (a) shall be applicable to any eligible member who, on or after
    24  the effective date of this section:
    25         (1)  has credit for at least 30 eligibility points;
    26         (2)  terminates State service; and
    27         (3)  files an application for an annuity.
    28     Section 3.  This act shall take effect in 60 days.
