                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, and the Pennsylvania
     3     Historical and Museum Commission, to accept by donation a
     4     tract of land situate in the Borough of Ambridge, Beaver
     5     County; and authorizing and directing the Department of        <--
     6     Conservation and Natural Resources, with the approval of the
     7     Governor, to convey to Theresa A. Care and Marion L. Care a
     8     certain tract of land situate in Pleasant Township, Warren
     9     County, in exchange for a certain tract of land.; AUTHORIZING  <--
    10     AND DIRECTING THE DEPARTMENT OF GENERAL SERVICES, WITH THE
    11     APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION
    12     AND THE GOVERNOR, TO GRANT AND CONVEY TO TINICUM TOWNSHIP
    13     CERTAIN LANDS AND BUILDINGS SITUATE IN THE TOWNSHIP OF
    14     TINICUM, COUNTY OF DELAWARE; AUTHORIZING AND DIRECTING THE
    15     DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
    16     PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION AND THE
    17     GOVERNOR, TO GRANT AND CONVEY TO LIBERTY TOWNSHIP CERTAIN
    18     LANDS AND MONUMENT SITUATE IN THE TOWNSHIP OF LIBERTY, COUNTY
    19     OF BEDFORD; AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES,
    20     WITH THE APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM
    21     COMMISSION AND THE GOVERNOR, TO GRANT AND CONVEY TO THE
    22     COUNTY OF MONTGOMERY CERTAIN LANDS AND BUILDINGS SITUATE IN
    23     THE BOROUGH OF POTTSTOWN, MONTGOMERY COUNTY; AUTHORIZING THE
    24     DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
    25     PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION AND THE
    26     GOVERNOR, TO GRANT AND CONVEY TO GREENE COUNTY CERTAIN LANDS
    27     AND BUILDING SITUATE IN JEFFERSON TOWNSHIP, GREENE COUNTY;
    28     AND AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES, WITH THE
    29     APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION
    30     AND THE GOVERNOR, TO GRANT AND CONVEY TO NORTHUMBERLAND
    31     COUNTY HISTORICAL SOCIETY, CERTAIN LANDS AND BUILDING SITUATE
    32     IN THE CITY OF SUNBURY, COUNTY OF NORTHUMBERLAND, AND
    33     COMMONWEALTH OF PENNSYLVANIA.


     1     The General Assembly of the Commonwealth of Pennsylvania
     2  hereby enacts as follows:
     3  Section 1.  Land acquisition in Borough of Ambridge, Beaver
     4                 County.
     5     (a)  Authorization.--The Department of General Services, with
     6  the approval of the Governor and the Pennsylvania Historical and
     7  Museum Commission, is hereby authorized on behalf of the
     8  Commonwealth of Pennsylvania to accept by donation a tract of
     9  land described in subsection (b).
    10     (b)  Property description.--The parcel to be donated by the
    11  Ambridge Area School District, pursuant to subsection (a) is
    12  located in the Borough of Ambridge, County of Beaver, bounded as
    13  described as follows:
    14     ALL THAT CERTAIN piece, parcel or plot of land situate in the
    15  Borough of Ambridge, County of Beaver and Commonwealth of
    16  Pennsylvania containing lots number 2, 3, 4, 5, 6, 7, 17, 18,
    17  19, 20, 21, 22, 23, 24, 25 and 26 in Block Number 10 as depicted
    18  in the "Economy Plan of French Point and Village Lots," recorded
    19  in the Recorder's Office in and for said County of Beaver in
    20  Plan Book Vol. 1, Page 234.
    21     CONTAINING an area of .9924 acres.
    22     (c)  Easements.--The donation shall be made under and subject
    23  to all recordable easements, servitudes and rights of others,
    24  including, but not confined to, streets, roadways and rights of
    25  any telephone, telegraph, water, electric, cable, sewer, gas or
    26  pipeline companies, as well as under and subject to any
    27  recordable interest, estates or tenancies vested in third
    28  persons, appearing of record, for any portion of the land or
    29  improvements erected thereon.
    30     (d) Deed.--The deed shall be prepared by the grantor as

     1  provided by law, subject to approval by the Department of
     2  General Services, and accepted on behalf of the Commonwealth by
     3  the Department of General Services.
     4     (e)  Costs and fees.--Costs and fees incidental to this
     5  donation shall be borne by the grantee unless otherwise
     6  stipulated by previous agreement.
     7  Section 2.  Land exchange in Pleasant Township, Warren County.    <--
     8     (a)  Authorization to convey.--The Department of Conservation
     9  and Natural Resources, with the approval of the Governor, is
    10  hereby authorized and directed on behalf of the Commonwealth of
    11  Pennsylvania to grant and convey to Theresa A. Care and Marion
    12  L. Care the following tract of land bounded and described as
    13  follows:
    14     All that certain lot, piece or parcel of land situated in
    15  Pleasant Township, Warren County, Commonwealth of Pennsylvania
    16  bounded and described as follows:
    17     Beginning at an iron pin corner, being a common corner of
    18  parcel 1, tax number WN-799-1333, now lands of Theresa A. Care
    19  and Marion L. Care and lands of the Commonwealth of Pennsylvania
    20  in Chapman State Park said corner being further described as
    21  being S39 degrees 26 minutes 13 seconds W, a distance of 107.85
    22  feet from a corner in the center of a private drive, a common
    23  corner of said lands of Theresa A. Care and Marion L. Care and
    24  lands of tax parcel number WN-799-2116, now or formerly lands of
    25  GLF Camp Group of Warren, thence from I.P. of beginning, along
    26  lands of Chapman State Park S39 degrees 26 minutes 13 seconds W,
    27  a distance 10.00 feet to a point; thence by lands herein and
    28  other lands of Chapman State Park N50 degrees 26 minutes 43
    29  seconds W, a distance of 97.46 feet to a point; thence by the
    30  same, N39 degrees 26 minutes 13 seconds E, a distance of 46.06

     1  feet to a railroad spike in a white pine corner, said corner
     2  being common to lands last mentioned and to lands of Theresa A.
     3  Care and Marion L. Care; thence along lands of Care S07 degrees
     4  20 minutes 17 seconds W, a distance of 42.62 feet to an iron
     5  pin; thence S50 degrees 26 minutes 43 seconds E, a distance of
     6  74.81 feet to an iron pin corner, place of beginning.
     7     Containing 1,382.89 square feet of land, more or less as
     8  shown on a plan prepared and surveyed by James P. Hunter
     9  Associates.
    10     Being a portion of a parcel of land, as contained in the deed
    11  from William T. Bevevino to the Commonwealth of Pennsylvania
    12  dated December 31, 1954, and recorded in Warren County Record
    13  Book 256, page 160.
    14     (b)  Property to be conveyed to Commonwealth.--The conveyance
    15  authorized under subsection (a) shall be in exchange for the
    16  conveyance by Theresa A. Care and Marion L. Care to the
    17  Commonwealth of Pennsylvania of a tract of land bounded and
    18  described as follows:
    19     All that certain lot, piece or parcel of land situated in
    20  Pleasant Township, Warren County, Commonwealth of Pennsylvania
    21  bounded and described as follows:
    22     Beginning at an iron pin corner, said corner being common to
    23  lands of Chapman State Park, lands of Theresa A. and Marion L.
    24  Care (tax parcel number WN-799/1333) and lands of tax parcel
    25  number WN-796/783, being lands now or formerly of Robert L.
    26  Hutchinson et ux, said corner being further described as being
    27  S34 degrees 44 minutes 17 seconds W, a distance of 57.74 feet,
    28  of a point in the center of a private drive at the common corner
    29  of lands of Theresa A. and Marion L. Care and lands of tax
    30  parcel number WN-796/783; thence from said iron pin corner and

     1  along line common to lands herein described and lands of tax
     2  parcel number WN-796-783 N34 degrees 44 minutes 17 seconds E, a
     3  distance of 21.23 feet to a point being common to lands last
     4  mentioned and to other lands of Theresa A. and Marion L. Care;
     5  thence by other lands of Theresa A. and Marion L. Care, S45
     6  degrees 15 minutes 43  seconds E, a distance of 142.75 feet to a
     7  point; thence S39 degrees 26 minutes 13 seconds E, a distance of
     8  21.00 feet to a railroad spike in a white pine corner, common to
     9  lands herein, other lands of Theresa A. and Marion L. Care and
    10  lands of the Commonwealth of Pennsylvania, being Chapman State
    11  Park; thence along lands of Chapman State Park N45 degrees 15
    12  minutes 43 seconds W, a distance of 141.00 feet to an iron pin,
    13  place of beginning.
    14     Containing 2,966.60 square feet of land, more or less as
    15  shown on a plan prepared and surveyed by James P. Hunter
    16  Associates.
    17     Being a portion of tax number WN-799/1333, as contained in
    18  the deed from Theresa Care, Executrix of the estate of Samuel T.
    19  Scalise, deceased, to Theresa A. Care and Marion L. Care dated
    20  March 16, 1993, and recorded in Warren County Record Book
    21  467/312.
    22     (c)  Conditions of conveyance.--Conveyance of the land
    23  described in subsection (a) shall be made under and subject to
    24  all easements, servitude and rights of others, including, but
    25  not confined to, streets, roadways and rights of telephone,
    26  telegraph, water, electric, sewer, gas or pipeline companies, as
    27  well as under and subject to any interest, estates or tenancies
    28  vested in third persons, whether or not appearing of record, for
    29  any portion of the land or improvements erected, thereon.
    30     (d)  Execution of deed.-- The deed of conveyance of the

     1  property described in subsection (a) shall be approved as
     2  provided by law and shall be executed by the Secretary of the
     3  Department of Conservation and Natural Resources in the name of
     4  the Commonwealth of Pennsylvania.
     5     (e)  Costs.--The parties to the transaction shall bear their
     6  respective costs.
     7  SECTION 2.  CONVEYANCE OF LAND TO TINICUM TOWNSHIP.               <--
     8     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
     9  THE APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM
    10  COMMISSION, AND THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED
    11  ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND
    12  CONVEY TO TINICUM TOWNSHIP, FOR ONE DOLLAR, APPROXIMATELY 7.224
    13  ACRES OF LAND AND BUILDINGS AS DESCRIBED IN SUBSECTION (B).
    14     (B)  PROPERTY DESCRIPTION.--THE PROPERTY TO BE CONVEYED
    15  PURSUANT TO SUBSECTION (A) CONSISTS OF ALL THAT CERTAIN TRACT OR
    16  PIECE OF LAND WITH THE BUILDINGS AND IMPROVEMENTS THEREON
    17  ERECTED, SITUATE IN THE TOWNSHIP OF TINICUM, COUNTY OF DELAWARE
    18  AND COMMONWEALTH OF PENNSYLVANIA, AND BOUNDED AND DESCRIBED AS
    19  FOLLOWS, TO WIT:
    20     BEGINNING AT THE POINT OF INTERSECTION OF THE MIDDLE LINE OF
    21  SECOND STREET AND THE MIDDLE LINE OF TAYLOR AVENUE; EXTENDING
    22  THENCE BY THE MIDDLE LINE OF SAID TAYLOR AVENUE SOUTH TEN
    23  DEGREES, FOUR MINUTES WEST, NINE HUNDRED FORTY-THREE FEET MORE
    24  OR LESS, TO LOW WATER MARK OF THE DELAWARE RIVER; EXTENDING
    25  THENCE BY THE SAID RIVER AND ALONG THE SAID LOW WATER MARK NORTH
    26  FIFTY-SIX DEGREES, SEVENTEEN MINUTES WEST THREE HUNDRED EIGHTY
    27  FEET MORE OR LESS TO LANDS OF THE CORINTHIAN YACHT CLUB;
    28  EXTENDING THENCE BY THE SAID LANDS NORTH NINE DEGREES FIFTY-FIVE
    29  MINUTES EAST, EIGHT HUNDRED THIRTY-SEVEN FEET MORE OR LESS TO
    30  THE MIDDLE OF THE SAID SECOND STREET; AND THENCE EXTENDING BY

     1  THE SAID MIDDLE LINE OF SECOND STREET SOUTH EIGHTY DEGREES,
     2  SIXTEEN MINUTES EAST, THREE HUNDRED FIFTY-THREE AND FIFTY-NINE
     3  ONE-HUNDREDTHS FEET TO THE PLACE OF BEGINNING.
     4     CONTAINING SEVEN AND TWO HUNDRED AND TWENTY-FOUR ONE-
     5  THOUSANDS (7.224) ACRES, MORE OR LESS, ACCORDING TO SURVEY MADE
     6  OCTOBER 20TH, 1926 BY DAMON & POWER, CIVIL ENGINEERS.
     7     (C)  EASEMENTS.--THE CONVEYANCE SHALL BE MADE UNDER AND
     8  SUBJECT TO ALL LAWFUL AND ENFORCEABLE EASEMENTS, SERVITUDES AND
     9  RIGHTS OF OTHERS, INCLUDING BUT NOT CONFINED TO STREETS,
    10  ROADWAYS AND RIGHTS OF ANY TELEPHONE, TELEGRAPH, WATER,
    11  ELECTRIC, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER AND
    12  SUBJECT TO ANY LAWFUL AND ENFORCEABLE ESTATES OR TENANCIES
    13  VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF
    14  THE LAND OR IMPROVEMENTS ERECTED THEREON.
    15     (D)  DEED.--THE DEED OF CONVEYANCE SHALL BE BY SPECIAL
    16  WARRANTY DEED OR QUIT CLAIM DEED, AS THE COMMONWEALTH'S
    17  INTERESTS PERMIT, AND SHALL BE EXECUTED BY THE SECRETARY OF
    18  GENERAL SERVICES IN THE NAME OF THE COMMONWEALTH OF
    19  PENNSYLVANIA. THE RESTRICTIVE COVENANTS IN SUBSECTIONS (E) AND
    20  (F) SHALL ONLY PERTAIN TO THE ABOVE MENTIONED SPECIAL WARRANTY
    21  DEED.
    22     (E)  PUBLIC ACCESS, ETC.--THE DEED OF CONVEYANCE SHALL
    23  CONTAIN A CLAUSE REQUIRING THAT TINICUM TOWNSHIP PROVIDE PUBLIC
    24  ACCESS TO THE PARK AND FACILITIES AND MAINTAIN AND PRESERVE THE
    25  PREMISES AS A HISTORIC PARK. NO NEW CONSTRUCTION, EXCAVATION,
    26  GROUND DISTURBANCE, DEMOLITION, ALTERATION, REMODELING OR
    27  LANDSCAPING/SITE WORK SHALL BE UNDERTAKEN OR PERMITTED TO BE
    28  UNDERTAKEN ON THE PROPERTY WITHOUT PRIOR WRITTEN APPROVAL OF THE
    29  PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION.
    30     (F)  OTHER TERMS AND CONDITIONS.--UNDER AND SUBJECT TO THE

     1  CONDITION THAT THE LAND HEREIN CONVEYED SHALL BE USED AS A
     2  PERMANENT, NONCOMMERCIAL HISTORICAL PARK, AND IF AT ANY TIME THE
     3  GRANTEE, OR ITS SUCCESSORS IN FUNCTION, CONVEYS SAID PROPERTY OR
     4  AUTHORIZES OR PERMITS SAID PROPERTY TO BE USED FOR ANY PURPOSE
     5  OTHER THAN THOSE AFOREMENTIONED, THE TITLE TO THE LAND HEREIN
     6  CONVEYED SHALL IMMEDIATELY REVERT TO AND REVEST IN THE
     7  COMMONWEALTH OF PENNSYLVANIA.
     8     (G)  COSTS AND FEES.--COSTS AND FEES INCIDENTAL TO THIS
     9  CONVEYANCE SHALL BE BORNE BY THE GRANTEE.
    10  SECTION 3.  CONVEYANCE OF LAND TO LIBERTY TOWNSHIP.
    11     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
    12  THE APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM
    13  COMMISSION, AND THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED
    14  ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND
    15  CONVEY TO LIBERTY TOWNSHIP, FOR ONE DOLLAR, APPROXIMATELY 20.87
    16  ACRES OF LAND AND MONUMENT AS DESCRIBED IN SUBSECTION (B).
    17     (B)  PROPERTY DESCRIPTION.--THE PROPERTY TO BE CONVEYED
    18  PURSUANT TO SUBSECTION (A) CONSISTS OF ALL THAT CERTAIN TRACT OR
    19  PIECE OF LAND WITH THE MONUMENT AND IMPROVEMENTS THEREON
    20  ERECTED, SITUATE IN THE TOWNSHIP OF LIBERTY, COUNTY OF BEDFORD
    21  AND COMMONWEALTH OF PENNSYLVANIA, AND BOUNDED AND DESCRIBED AS
    22  FOLLOWS, TO WIT:
    23     BEGINNING AT THE CENTER OF A CERTAIN SHAFT OR MARKER ERECTED
    24  BY THE FISHER'S SUMMIT MEMORIAL ASSOCIATION AS A MARKER, OR
    25  MONUMENT OR THE SPOT WHERE CAPTAIN PHILLIPS' SCOUTS WERE
    26  MASSACRED BY INDIANS, AND WHERE THE REMAINS OF THE SAID SCOUTS
    27  ARE INTERRED IN A CERTAIN VAULT OR GRAVE, AND EXTENDING FROM THE
    28  SAID MARKER OR MONUMENT IN ALL DIRECTIONS BY A RADIUS OF 500
    29  FEET FROM THE CENTER OF SAID MARKER AS AFORESAID AND CONTAINING
    30  APPROXIMATELY 785,400 SQUARE FEET, AND ALSO THAT PORTION OR

     1  PIECE OF GROUND BEGINNING AT THE SAID MONUMENT OR MARKER AND
     2  USED AS A CERTAIN ROAD, EXTENDING IN AN EASTERLY DIRECTION TO
     3  THE OLD HIGHWAY FORMERLY KNOW AS ROUTE 26, FOR A WIDTH OF 50
     4  FEET BETWEEN SAID MARKER AND THE AFORESAID HIGHWAY; AND THENCE
     5  FROM THE OLD HIGHWAY HEREINBEFORE MENTIONED CONTINUING IN AN
     6  EASTERLY DIRECTION TO THE NEW CONCRETE HIGHWAY, BETWEEN BEDFORD
     7  AND HUNTINGDON, AND KNOWN AS ROUTE 26, FOR A WIDTH OF 50 FEET,
     8  BETWEEN THE OLD AND NEW HIGHWAYS HEREIN BEFORE MENTIONED.
     9     (C)  EASEMENTS.--THE CONVEYANCE SHALL BE MADE UNDER AND
    10  SUBJECT TO ALL LAWFUL AND ENFORCEABLE EASEMENTS, SERVITUDES AND
    11  RIGHTS OF OTHERS, INCLUDING BUT NOT CONFINED TO STREETS,
    12  ROADWAYS AND RIGHTS OF ANY TELEPHONE, TELEGRAPH, WATER,
    13  ELECTRIC, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER AND
    14  SUBJECT TO ANY LAWFUL AND ENFORCEABLE ESTATES OR TENANCIES
    15  VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF
    16  THE LAND OR IMPROVEMENTS ERECTED THEREON.
    17     (D)  DEED.--THE DEED OF CONVEYANCE SHALL BE BY SPECIAL
    18  WARRANTY DEED AND SHALL BE EXECUTED BY THE SECRETARY OF GENERAL
    19  SERVICES IN THE NAME OF THE COMMONWEALTH OF PENNSYLVANIA.
    20     (E)  PUBLIC ACCESS, ETC.--THE DEED OF CONVEYANCE SHALL
    21  CONTAIN A CLAUSE REQUIRING THAT LIBERTY TOWNSHIP PROVIDE PUBLIC
    22  ACCESS TO THE PARK AND MONUMENT AND MAINTAIN AND PRESERVE THE
    23  PREMISES AS A HISTORIC PARK. NO NEW CONSTRUCTION, EXCAVATION,
    24  GROUND DISTURBANCE, DEMOLITION, ALTERATION, REMODELING OR
    25  LANDSCAPING/SITE WORK SHALL BE UNDERTAKEN OR PERMITTED TO BE
    26  UNDERTAKEN ON THE PROPERTY WITHOUT PRIOR WRITTEN APPROVAL OF THE
    27  PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION.
    28     (F)  COVENANTS.--UNDER AND SUBJECT TO THE CONDITION THAT THE
    29  LAND HEREIN CONVEYED SHALL BE USED AS A PERMANENT, NONCOMMERCIAL
    30  HISTORICAL PARK, AND IF AT ANY TIME THE GRANTEE, OR ITS

     1  SUCCESSORS IN FUNCTION, CONVEYS SAID PROPERTY OR AUTHORIZES OR
     2  PERMITS SAID PROPERTY TO BE USED FOR ANY PURPOSE OTHER THAN
     3  THOSE AFOREMENTIONED, THE TITLE TO THE LAND HEREIN CONVEYED
     4  SHALL IMMEDIATELY REVERT TO AND REVEST IN THE COMMONWEALTH OF
     5  PENNSYLVANIA.
     6     (G)  COSTS AND FEES.--COSTS AND FEES INCIDENTAL TO THIS
     7  CONVEYANCE SHALL BE BORNE BY THE GRANTEE.
     8  SECTION 4.  CONVEYANCE OF LAND TO MONTGOMERY COUNTY.
     9     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
    10  THE APPROVAL OF THE PENNSYLVANIA HISTORICAL AND MUSEUM
    11  COMMISSION, AND THE GOVERNOR, IS HEREBY AUTHORIZED ON BEHALF OF
    12  THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND CONVEY TO THE
    13  COUNTY OF MONTGOMERY, CERTAIN LANDS AND BUILDINGS AS DESCRIBED
    14  IN SUBSECTION (B) FOR FAIR CONSIDERATION EQUAL TO THE FAIR
    15  MARKET VALUE OF THE PROPERTY AS DETERMINED BY AN INDEPENDENT
    16  APPRAISAL IN ACCORDANCE WITH AN AGREEMENT OF SALE.
    17     (B)  PROPERTY DESCRIPTION.--THE TRACTS TO BE CONVEYED ARE
