SENATE BILL

No. 1169 Session of 2001

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey to Indiana
     3     County, certain lands situate in the Borough of Indiana,
     4     Indiana County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services, with the
     8  approval of the Governor, is hereby authorized on behalf of the
     9  Commonwealth of Pennsylvania to grant and convey Indiana County
    10  certain land and buildings described in section 2 for fair
    11  consideration equal to fair market value as determined by
    12  independent appraisal in accordance with an Agreement of Sale to
    13  be executed with the Department of General Services.
    14     Section 2.  The property to be conveyed pursuant to section 1
    15  consists of approximately 0.88-acres and a building bounded and
    16  more particularly described as follows:
    17     BEGINNING at an iron pin 37.5 feet from the centerline of
    18  North 4th Street; thence along the lands now or formerly of the


     1  Commonwealth of Pennsylvania, North 89 degrees 38 minutes 01.2
     2  seconds West 228.46 feet to a point; thence North 00 degrees 52
     3  minutes 00 seconds East 165.65 feet to a point; thence North 89
     4  degrees 12 minutes 00 seconds East 228.54 feet to a point;
     5  thence South 00 degrees 52 minutes 00 seconds West 170.30 feet
     6  to a point the place of BEGINNING.
     7     CONTAINING 0.88-acres, more or less.
     8     Section 3.  The conveyance shall be made under and subject to
     9  all lawful and enforceable easements, servitudes and rights of
    10  others, including but not confined to streets, roadways and
    11  rights of any telephone, telegraph, water, electric, gas or
    12  pipeline companies, as well as under and subject to any lawful
    13  and enforceable estates or tenancies vested in third persons
    14  appearing of record, for any portion of the land or improvements
    15  erected thereon.
    16     Section 4.  The deed of conveyance shall be by Special
    17  Warranty Deed and shall be executed by the Secretary of General
    18  Services in the name of the Commonwealth of Pennsylvania.
    19     Section 5.  Costs and fees incidental to this conveyance
    20  shall be borne by the Grantee.
    21     Section 6.  In the event that this conveyance is not executed
    22  in accordance with the Agreement of Sale as referenced in
    23  section 1, the property may be disposed of in accordance with
    24  Article 2406-A of the act of April 9, 1929 (P.L.177, No.175),
    25  known as The Administrative Code of 1929.
    26     Section 7.  This act shall take effect immediately.
