SENATE BILL

No. 1116 Session of 2001

                                     AN ACT

     1  Authorizing and directing the Department of Transportation, with
     2     the approval of the Governor, to grant and convey to the City
     3     of Wilkes-Barre land situate in the City of Wilkes-Barre,
     4     Luzerne County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Land in Wilkes-Barre, Luzerne County.
     8     (a)  Authorization.--The Department of Transportation, with
     9  the approval of the Governor, is authorized and directed on
    10  behalf of the Commonwealth to grant and convey to the City of
    11  Wilkes-Barre certain land situate in the City of Wilkes-Barre
    12  and described in subsection (b) for $14,000.
    13     (b)  Description.--The property to be conveyed pursuant to
    14  subsection (a) consists of 1.066 acres more particularly
    15  described as follows:
    16     Beginning at a rebar on the Westerly right of way line of
    17  Wilkes-Barre Boulevard said point being located 45 Feet left of
    18  centerline station 181+10 as shown on the SR 309 Section 003R/W


     1  plan.
     2     Thence continuing along said right of way line the following
     3  two courses:
     4         (1)  Along a 999.93 Feet radius curve to the Right (chord
     5     bears N24 degrees 46 minutes 16 seconds E 224.66 Feet) 225.13
     6     Feet to a rebar,
     7         (2)  Thence N12 degrees 02 minutes 37 seconds W for 33.19
     8     Feet to a rebar being the intersection of said right of way
     9     line and the Southerly right of way line of North Washington
    10     Street.
    11     Thence continuing along said Southerly right of way line of
    12  North Washington Street along a 276.56 Feet radius curve to the
    13  Left (chord bears N77 degrees 47 minutes 02 seconds W 205.05
    14  Feet) 210.06 Feet to a rebar; thence leaving said right of way
    15  line S80 degrees 27 minutes 23 seconds W for 58.19 Feet to a
    16  rebar; thence S24 degrees 19 minutes 14 seconds E for 162.28
    17  Feet to a rebar; thence S4 degrees 59 minutes 40 seconds W for
    18  82.19 Feet to a rebar; thence S69 degrees 58 minutes 27 seconds
    19  E for 118.05 Feet, to the Point of Beginning.
    20     (c)  Easements.--The conveyance shall be made under and
    21  subject to all of the following:
    22         (1)  Lawful and enforceable easements, servitudes and
    23     rights of others. This paragraph includes streets; roadways;
    24     and rights of any telephone, telegraph, water, electric, gas
    25     or pipeline company.
    26         (2)  Lawful and enforceable estates or tenancies vested
    27     in third persons appearing of record.
    28     (d)  Execution.--The deed of conveyance shall be by special
    29  warranty deed and shall be executed by the Secretary of
    30  Transportation in the name of the Commonwealth.

     1     (e)  Costs.--Costs and fees incidental to this conveyance
     2  shall be borne by the grantee.
     3  Section 2.  Effective date.
     4     This act shall take effect immediately.
