                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing an incentive program to
     6     increase enrollment at area vocational-technical schools; and
     7     making an appropriation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 2595.1.  Area Vocational-Technical School Enrollment
    14  Incentive Program.--(a)  Any school district that sponsors an
    15  area vocational-technical school is eligible to participate in
    16  the enrollment incentive program.
    17     (b)  Incentives shall be provided annually to school
    18  districts which sponsor area vocational-technical schools and


     1  which meet or exceed their enrollment goals as those enrollment
     2  goals are established in the area vocational-technical schools
     3  articles of agreement. Payment of enrollment incentive funds to
     4  school districts that meet or exceed their enrollment goals
     5  shall be based on a school district's increase in student
     6  enrollment. For the purposes of this section, enrollment goals
     7  shall be enrollment goals in effect in the year prior to the
     8  year in which the enrollment incentive is paid.
     9     (c)  Any school district may apply to the Department of
    10  Education for enrollment incentive funds under this section by
    11  submitting data showing that the school district has met or
    12  exceeded its enrollment goal. Data showing that the school
    13  district has met or exceeded its enrollment goal must compare
    14  the school district's enrollment in an area vocational-technical
    15  school in the year prior to the year in which enrollment
    16  incentives are paid to the school district's enrollment in an
    17  area vocational-technical school in the year in which enrollment
    18  incentives are paid.
    19     (d)  For purposes of this section, a school district shall be
    20  eligible for enrollment incentive funds under the following
    21  circumstances:
    22     (i)  Where a school district's enrollment data shows that the
    23  school district has met its enrollment goal, the increase in
    24  student enrollment shall be equal to the difference between the
    25  school district's enrollment goal and the school district's
    26  actual enrollment in an area vocational-technical school in the
    27  year prior to the year in which the enrollment incentive is
    28  paid.
    29     (ii)  Where a school district's enrollment data shows that
    30  the school district has exceeded its enrollment goal, the

     1  increase in student enrollment shall be equal to the difference
     2  between the school district's actual enrollment in the area
     3  vocational-technical school and the school district's enrollment
     4  in the area vocational-technical school in the year prior to the
     5  year in which the enrollment incentive is paid.
     6     (e)  The Secretary of Education shall award a school district
     7  that applies for enrollment incentive funds under subsection (c)
     8  and that meets or exceeds its enrollment goal an amount
     9  determined by multiplying the increase in student enrollment as
    10  determined by subsection (d) by a fixed amount per student
    11  established annually when the appropriation for the area
    12  vocational-technical school enrollment incentive program is
    13  established. The fixed amount per student shall not exceed two
    14  thousand dollars ($2,000).
    15     (f)  Enrollment incentive funds shall be paid only to school
    16  districts that qualify pursuant to subsection (b).
    17     Section 2.  The sum of $10,000,000, or as much thereof as may
    18  be necessary, is hereby appropriated to the Department of
    19  Education for the fiscal year July 1, 2001, to June 30, 2002,
    20  for purposes of enrollment incentive payments for area
    21  vocational-technical schools.
    22     Section 3.  This act shall take effect July 1, 2001.
