AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," mandating prompt reporting 21 of vacancies on boards and commissions. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. The act of April 9, 1929 (P.L.177, No.175), known 25 as The Administrative Code of 1929, is amended by adding a 26 section to read:
1 Section 207.2. Prompt Reporting of Vacancies.--(a) The 2 chairperson or other head member of a board, commission or other 3 entity comprised, wholly or in part, of members appointed by the 4 Governor or the General Assembly or both shall, within 30 days 5 of the date when a vacancy occurs, report the vacancy to the 6 head of the department in which the board, commission or other 7 entity resides or, if the board, commission or other entity does 8 not reside in a department, to the Secretary of Administration. 9 (b) Wilful failure of a person to comply with the 10 requirements of this section shall result in immediate removal 11 of that person from all boards, commissions and other entities 12 of which that person is a member. 13 (c) If the position of chairperson or other head member of 14 an entity to which this section applies is vacant when a vacancy 15 covered by this section occurs, the acting chairperson or other 16 acting head shall comply with the reporting requirement of 17 subsection (a) on behalf of the chairperson or other head member 18 of the entity. If there is no acting chairperson or other acting 19 head, the senior member in terms of years of service shall 20 comply with the reporting requirement of subsection (a) on 21 behalf of the chairperson or other head member of the entity. 22 Section 2.
