                                     AN ACT

     1  Amending Title 65 (Public Officers) of the Pennsylvania
     2     Consolidated Statutes, further providing for statement of
     3     financial interests.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1104(b)(3) of Title 65 of the
     7  Pennsylvania Consolidated Statutes is amended to read:
     8  § 1104.  Statement of financial interests required to be filed.
     9     * * *
    10     (b)  Candidate.--
    11         * * *
    12         (3)  [No] If a petition to appear on the ballot for
    13     election [shall be accepted by] is filed with the respective
    14     State or local election officials [unless] and the petition
    15     [has] does not have appended thereto a statement of financial
    16     interests as set forth in paragraphs (1) and (2)[. Failure to
    17     file the statement in accordance with the provisions of this
    18     chapter shall, in addition to any other penalties provided,

     1     be a fatal defect to a petition to appear on the ballot.],
     2     the candidate for office may file the statement of financial
     3     interests after the last day for filing a petition if in the
     4     discretion of the Commonwealth Court in the case of a
     5     petition for a State office or in the discretion of the
     6     county court of common pleas in the case of a petition for a
     7     county or local office the court finds that there was a good
     8     faith effort to timely file the statement and that the
     9     statement has since been filed as set forth in paragraphs (1)
    10     and (2).

    12     Section 2.  This act shall take effect in 60 days.
