AN ACT
1 To provide from the General Fund for the expenses of the
2 Executive, Legislative and Judicial Departments of the
3 Commonwealth, the public debt and for the public schools for
4 the fiscal year July 1, 2002, to June 30, 2003, for certain
5 institutions and organizations, and for the payment of bills
6 incurred and remaining unpaid at the close of the fiscal year
7 ending June 30, 2002; to provide appropriations from the
8 State Lottery Fund, the Energy Conservation and Assistance
9 Fund, the Hazardous Material Response Fund, The State Stores
10 Fund, the Milk Marketing Fund, the Home Investment Trust
11 Fund, the Emergency Medical Services Operating Fund, the
12 Tuition Payment Fund, the Banking Department Fund, the
13 Firearm Records Check Fund and the Ben Franklin Technology
14 Development Authority Fund to the Executive Department; to
15 provide appropriations from the Judicial Computer System
16 Augmentation Account to the Judicial Department for the
17 fiscal year July 1, 2002, to June 30, 2003; to provide
18 appropriations from the Motor License Fund for the fiscal
19 year July 1, 2002, to June 30, 2003, for the proper operation
20 of the several departments of the Commonwealth and the
21 Pennsylvania State Police authorized to spend Motor License
22 Fund moneys; to provide for the appropriation of Federal
23 funds to the Executive Department of the Commonwealth and for
24 the establishment of restricted receipt accounts for the
25 fiscal year July 1, 2002, to June 30, 2003, and for the
26 payment of bills remaining unpaid at the close of the fiscal
27 year ending June 30, 2002; and to provide for the additional
28 appropriation of Federal and State funds for the Executive
29 Department of the Commonwealth for the fiscal year July 1,
30 2001, to June 30, 2002, and for the payment of bills incurred
31 and remaining unpaid at the close of the fiscal year ending
32 June 30, 2001.

18 The General Assembly of the Commonwealth of Pennsylvania
19 hereby enacts as follows:
20 PART I
21 GENERAL PROVISIONS
22 Section 101. Short title.--This act shall be known and may
23 be cited as the General Appropriation Act of 2002.
24 Section 102. Definitions.--The following words and phrases
25 when used in this act shall have the meanings given to them in
26 this section unless the context clearly indicates otherwise:
27 "Employees." Includes all directors, superintendents, bureau
28 or division chiefs, assistant directors, assistant
29 superintendents, assistant chiefs, experts, scientists,
30 engineers, surveyors, draftsmen, accountants, secretaries,

1 auditors, inspectors, examiners, analysts, statisticians,
2 marshals, clerks, stenographers, bookkeepers, messengers and
3 other assistants in any department, board or commission.
4 "Expenses" and "maintenance." Includes all printing, binding
5 and stationery, food and forage, materials and supplies,
6 traveling expenses, training, motor vehicle supplies and
7 repairs, freight, express and cartage, postage, telephones and
8 telegraph rentals and toll charges, newspaper advertising and
9 notices, public advertising by or through any medium, fuel,
10 light, heat, power and water, minor construction and renovation,
11 repairs or reconstruction of equipment, buildings and
12 facilities, rent of real estate and equipment, premiums on
13 workers' compensation, insurance premiums on policies of
14 liability insurance, insurance premiums on medical payment
15 insurance and surety bonds for volunteer workers, premiums on
16 employee group life insurance and employee and retired employee
17 group hospital and medical insurance, payment of Commonwealth
18 share of Social Security taxes and unemployment compensation
19 costs for State employees, the purchase of replacement or
20 additional equipment and machinery and all other incidental
21 costs and expenses, including payment to the Department of
22 General Services of mileage and other charges for the use of
23 automobiles and rental payments for permanently assigned
24 automobiles and of expenses or costs of services incurred
25 through the Purchasing Fund. The term "expenses" also shall
26 include the medical costs for the treatment of inmates of State
27 institutions when the inmate must be transferred to an outside
28 hospital: Provided, That in no case shall the State institution
29 pay more for patient care than that provided under the State
30 medical assistance program.

3 Section 104. State appropriations.--(a) General Fund.--The
4 following sums set forth in this act, or as much thereof as may
5 be necessary, are hereby specifically appropriated from the
6 General Fund to the several hereinafter named agencies of the
7 Executive, Legislative and Judicial Departments of the
8 Commonwealth for the payment of salaries, wages or other
9 compensation and travel expenses of the duly elected or
10 appointed officers and employees of the Commonwealth, for the
11 payment of fees for contractual services rendered, for the
12 purchase or rental of goods and services, printing, public
13 advertising by or through any medium, equipment, land and
14 buildings and for payment of any other expenses, as provided by
15 law or by this act, necessary for the proper conduct of the
16 duties, functions and activities and for the purposes
17 hereinafter set forth for the fiscal year beginning July 1,
18 2002, and for the payment of bills incurred and remaining unpaid
19 at the close of the fiscal year ending June 30, 2002.
20 (b) State Lottery Fund.--The following sums set forth in
21 this act, or as much thereof as may be necessary, are hereby
22 specifically appropriated from the State Lottery Fund to the
23 several hereinafter named agencies of the Executive Department
24 of the Commonwealth for the payment of salaries, wages or other
25 compensation and travel expenses of the duly appointed officers
26 and employees of the Commonwealth, for the payment of fees for
27 contractual services rendered, for the purchase or rental of
28 goods and services and for payment of any other expenses, as
29 provided by law or by this act, necessary for the proper conduct
30 of the duties, functions and activities and for the purposes

1 hereinafter set forth for the fiscal year beginning July 1,
2 2002, and for the payment of bills incurred and remaining unpaid
3 at the close of the fiscal year ending June 30, 2002.
4 (c) Energy Conservation and Assistance Fund.--The following
5 sums set forth in this act, or as much thereof as may be
6 necessary, are hereby specifically appropriated from the Energy
7 Conservation and Assistance Fund to the several hereinafter
8 named agencies of the Executive Department of the Commonwealth
9 for the payment of fees for contractual services rendered, for
10 the purchase or rental of goods and services and for the payment
11 of any other expenses, as provided by law or by this act,
12 necessary for the proper conduct of the duties, functions and
13 activities and for the purposes hereinafter set forth for the
14 fiscal year beginning July 1, 2002, and for the payment of bills
15 incurred and remaining unpaid at the close of the fiscal year
16 ending June 30, 2002.
17 (d) Judicial Computer System Augmentation Account.--The
18 following sums set forth in this act, or as much thereof as may
19 be necessary, are hereby specifically appropriated from the
20 restricted receipt account established within the General Fund,
21 known as the Judicial Computer System Augmentation Account, to
22 the Judicial Department of the Commonwealth for the payment of
23 salaries, wages or other compensation and travel expenses, for
24 the payment of fees for contractual services rendered, for the
25 purchase or rental of goods and services and for the payment of
26 any other expenses, as provided by law or by this act, necessary
27 for the proper conduct of the duties, functions and activities
28 and for the purposes hereinafter set forth for the fiscal year
29 beginning July 1, 2002, and for the payment of bills incurred
30 and remaining unpaid at the close of the fiscal year ending June

1 30, 2002.
2 (e) Emergency Medical Services Operating Fund.--The
3 following sums set forth in this act, or as much thereof as may
4 be necessary, are hereby specifically appropriated from the
5 Emergency Medical Services Operating Fund to the several
6 hereinafter named agencies of the Executive Department of the
7 Commonwealth for the payment of fees for contractual services
8 rendered, for the purchase or rental of goods and services and
9 for the payment of any other expenses, as provided by law or by
10 this act, necessary for the proper conduct of the duties,
11 functions and activities and for the purposes hereinafter set
12 forth for the fiscal year beginning July 1, 2002, and for the
13 payment of bills incurred and remaining unpaid at the close of
14 the fiscal year ending June 30, 2002.
15 (f) The State Stores Fund.--The following sums set forth in
16 this act, or as much thereof as may be necessary, are hereby
17 specifically appropriated from The State Stores Fund to the
18 hereinafter named agency of the Executive Department of the
19 Commonwealth for the payment of salaries, wages or other
20 compensation and travel expenses of the duly appointed officers
21 and employees of the Commonwealth, for the payment of fees for
22 contractual services rendered, for the purchase or rental of
23 goods and services and for the payment of any other expenses, as
24 provided by law or by this act, necessary for the proper conduct
25 of the duties, functions and activities and for the purposes
26 hereinafter set forth for the fiscal year beginning July 1,
27 2002, and for the payment of bills incurred and remaining unpaid
28 at the close of the fiscal year ending June 30, 2002.
29 (g) Motor License Fund.--The following sums, or as much
30 thereof as may be necessary, are hereby appropriated from the

1 Motor License Fund to the hereinafter named agencies of the
2 Executive Department for the payment of salaries, wages and
3 other compensation and travel expenses of the duly elected or
4 appointed officers and employees of the Commonwealth, for
5 contractual services and other expenses necessary for the proper
6 conduct of the duties, functions and activities for the purposes
7 hereinafter set forth for the fiscal year beginning July 1,
8 2002, and for the payment of bills incurred and remaining unpaid
9 at the close of the fiscal year ending June 30, 2002.
10 (h) Aviation Restricted Revenue Account.--The following
11 sums, or as much thereof as may be necessary, are hereby
12 appropriated from the Aviation Restricted Revenue Account in the
13 Motor License Fund to the hereinafter named agencies of the
14 Executive Department for the purposes set forth herein for the
15 fiscal year beginning July 1, 2002, and for the payment of bills
16 incurred and remaining unpaid at the close of the fiscal year
17 ending June 30, 2002.
18 (i) Hazardous Material Response Fund.--The following sums
19 set forth in this act, or as much thereof as may be necessary,
20 are hereby specifically appropriated from the Hazardous Material
21 Response Fund to the several hereinafter named agencies of the
22 Executive Department of the Commonwealth for the payment of fees
23 for contractual services rendered, for the purchase or rental of
24 goods and services and for the payment of any other expenses, as
25 provided by law or by this act, necessary for the proper conduct
26 of the duties, functions and activities and for the purposes
27 hereinafter set forth for the fiscal year beginning July 1,
28 2002, and for the payment of bills incurred and remaining unpaid
29 at the close of the fiscal year ending June 30, 2002.
30 (j) Milk Marketing Fund.--The following sums set forth in

1 this act, or as much thereof as may be necessary, are hereby
2 specifically appropriated from the Milk Marketing Fund to the
3 several hereinafter named agencies of the Executive Department
4 of the Commonwealth for the payment of salaries, wages or other
5 compensation and travel expenses of the duly appointed officers
6 and employees of the Commonwealth, for the payment of fees for
7 contractual services rendered, for the purchase or rental of
8 goods and services and for the payment of any other expenses, as
9 provided by law or by this act, necessary for the proper conduct
10 of the duties, functions and activities and for the purposes
11 hereinafter set forth for the fiscal year beginning July 1,
12 2002, and for the payment of bills incurred and remaining unpaid
13 at the close of the fiscal year ending June 30, 2002.
14 (k) Home Investment Trust Fund.--The following sums set
15 forth in this act, or as much thereof as may be necessary, are
16 hereby specifically appropriated from the Home Investment Trust
17 Fund to the hereinafter named agencies of the Executive
18 Department of the Commonwealth for the payment of salaries,
19 wages or other compensation and travel expenses of the duly
20 appointed officers and employees of the Commonwealth, for the
21 payment of fees for contractual services rendered, for the
22 purchase or rental of goods and services and for the payment of
23 any other expenses, as provided by law or by this act, necessary
24 for the proper conduct of the duties, functions and activities
25 and for the purposes hereinafter set forth for the fiscal year
26 beginning July 1, 2002, and for the payment of bills incurred
27 and remaining unpaid at the close of the fiscal year ending June
28 30, 2002.
29 (l) Tuition Payment Fund.--The following sums set forth in
30 this act, or as much thereof as may be necessary, are hereby

1 specifically appropriated from the Tuition Payment Fund to the
2 hereinafter named agencies of the Executive Department of the
3 Commonwealth for the payment of salaries, wages or other
4 compensation and travel expenses of the duly appointed officers
5 and employees of the Commonwealth, for the payment of fees for
6 contractual services rendered, for the purchase or rental of
7 goods and services and for the payment of any other expenses, as
8 provided by law or by this act, necessary for the proper conduct
9 of the duties, functions and activities and for the purposes
10 hereinafter set forth for the fiscal year beginning July 1,
11 2002, and for the payment of bills incurred and remaining unpaid
12 at the close of the fiscal year ending June 30, 2002.
13 (m) Banking Department Fund.--The following sums set forth
14 in this act, or as much thereof as may be necessary, are hereby
15 specifically appropriated from the Banking Department Fund to
16 the hereinafter named agencies of the Executive Department of
17 the Commonwealth for the payment of salaries, wages or other
18 compensation and travel expenses of the duly appointed officers

9 Section 106. Block grants.--(a) Appropriation.--The
10 following sums set forth in this act, or as much thereof as may
11 be necessary, are hereby specifically appropriated from the
12 block grant (BG) funds to the several hereinafter named agencies
13 of the Executive Department of the Commonwealth for the
14 purposes, and under the restrictions, for which the funds are
15 provided for the fiscal year beginning July 1, 2002.
16 (b) Small Communities Development Block Grant.--The Small
17 Communities Development Block Grant (SCDBG) is to assist small
18 cities and communities that have a high concentration of
19 impoverished citizens and substandard housing to expand their
20 low-income and moderate-income housing opportunities and to meet
21 community development needs.
22 (c) Community Services Block Grant.--The Community Services
23 Block Grant (CSBG) is to provide a range of services and
24 activities having a measurable and potentially major impact on
25 the causes of poverty in the community or those areas of the
26 community where poverty is a particularly acute problem. In
27 addition, new focus may be placed on the unemployed, both old
28 and new. Local agencies may lower their eligibility requirements
29 for recipients to three months to allow greater flexibility to
30 assure proper consideration of each recipient.

1 (d) Preventive Health and Health Services Block Grant.--The
2 Preventive Health and Health Services Block Grant (PHHSBG) is
3 for the provision of preventive health and other health services
4 related to emergency medical systems, health initiative grants,
5 comprehensive public health, hypertension, fluoridation, health
6 education, risk reduction, home health, rape crisis and domestic
7 violence services.
8 (e) Maternal and Child Health Services Block Grant.--The
9 Maternal and Child Health Services Block Grant (MCHSBG) is to
10 enable states to maintain and strengthen their leadership in
11 planning, promoting, coordinating and evaluating health care for
12 pregnant women, mothers, infants and children, and children with
13 special health care needs, and in providing health services for
14 mothers and children who do not have access to adequate health
15 care.
16 (f) Low-Income Home Energy Assistance Block Grant.--The Low-
17 Income Home Energy Assistance Block Grant (LIHEABG) is to help
18 lessen the impact of the high cost of energy on low-income
19 families and individuals, including energy efficiency grants for
20 low-income dwellings. No less than 15% of the LIHEABG funds
21 received shall be used for weatherization. LIHEABG funds
22 received pursuant to a Presidential release of contingency funds
23 shall be exempt from the 15% requirement. Unexpended
24 weatherization funds which would result in LIHEABG funds being
25 returned to the Federal Department of Health and Human Services
26 may be spent for assistance grants at the discretion of the
27 Secretary of the Budget. The Secretary of the Budget shall
28 notify the chairman and the minority chairman of the
29 Appropriations Committee of the Senate and the chairman and the
30 minority chairman of the Appropriations Committee of the House

1 of Representatives of the intent to reallocate any such funds
2 ten days prior to any reallocation.
3 (g) Social Services Block Grant.--The Social Services Block
4 Grant (SSBG) is for the provision of social services to eligible

7 Services Block Grant (MHSBG) provides funds for the provision of
8 services to adults with serious mental illness or children with
9 serious emotional disturbance.
10 (i) Substance Abuse Block Grant.--The Substance Abuse Block
11 Grant (SABG) provides funds to establish and maintain programs
12 to combat alcohol and drug abuse.
13 (j) Child Care and Development Fund Block Grant.--The Child
14 Care and Development Fund Block Grant (CCDFBG) is for the
15 provision of direct child care or to increase the quality and
16 availability of child care for low-income families.
17 (k) Temporary Assistance for Needy Families Block Grant.--

11 MISCELLANEOUS PROVISIONS FOR 2001-2002
12 Section 1791. Prior laws unaffected.--This act is not
13 intended to be inconsistent with or to repeal any provision of
14 any act enacted at this or any prior session of the General
15 Assembly regulating the purchase of supplies, the ordering of
16 printing and binding, the purchase, maintenance and use of
17 automobiles, the method of making payments from the State
18 Treasury for any purpose or the functioning of any
19 administrative department, board or commission.
20 Section 1792. Compliance with other law before funds
21 available.--No appropriation made by this part to any
22 department, board, commission or agency of the Executive
23 Department shall be available unless and until the department,
24 board, commission or agency has complied with sections 615 and
25 616 of the act of April 9, 1929 (P.L.177, No.175), known as The
26 Administrative Code of 1929.
27 Section 1793. Contracts prerequisite to encumbering or
28 committing funds.--Funds for the purchase of supplies, materials
29 and equipment shall not be deemed to be committed or encumbered
30 until contracts covering the purchase have been entered into

1 with the vendors.
2 Section 1794. Minority business set-asides.--(a) Each
3 department or other instrumentality of the Commonwealth listed
4 in Subpart B authorized to contract for buildings, highways,
5 commodities, equipment, supplies or services shall report to the
6 General Assembly all information pertinent to anticipated
7 procurement needs at the beginning of each fiscal year and each
8 fiscal quarter thereafter.
9 (b) As used in this section, the term "minority business"
10 means a minority business enterprise as defined in the act of
11 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
12 Minority Business Development Authority Act.
13 Section 1795. Appropriation of funds from miscellaneous
14 sources.--(a) In addition to the amounts appropriated by this
15 part, moneys received in payment for food and household supplies
16 furnished to employees and other persons, except inmates, by an
17 institution, and moneys received from the proceeds from the sale
18 of any products of the soil, meats, livestock, timber or other
19 materials sold by the department shall be paid into the General
20 Fund and are hereby appropriated out of the General Fund to the
21 several respective institutions for the operation and
22 maintenance of the institutions.
23 (b) In addition to the amounts appropriated by this part,
24 all moneys received from any other source, except the Federal
25 Government, as contributions for the programs provided herein or
26 as payment for services or materials furnished by one
27 institution to another, except those collections designated as
28 revenues, shall be paid into the General Fund and are hereby
29 appropriated out of the General Fund for the purposes of the
30 respective appropriations.

1 (c) In addition to any funds specifically appropriated by
2 this part, all moneys received by a department or agency of the
3 Commonwealth from any other sources, except the Federal
4 Government, as contributions or supplements to the department or
5 agency for a program or administration of an act included in
6 this part shall be paid into the General Fund and credited to
7 the appropriation for that program or administration of the act.
8 Section 1796. Lapsing of unused funds.--(a) Except as
9 otherwise provided by law or by this section, that part of all
10 appropriations in Part XVII unexpended, uncommitted or
11 unencumbered as of June 30, 2002, shall automatically lapse as
12 of that date.
13 (b) The appropriation in part XVII to the Pennsylvania
14 Emergency Management Agency for the June 2001 storm disaster
15 hazard mitigation shall lapse on June 30, 2004.
16 (c) The appropriations in sections 1711, 1715, 1716, 1718,
17 1720 and 1721, for the Homeland Security Initiative or any
18 component thereof shall not lapse to the General Fund and any
19 amounts unexpended or unencumbered on June 30, 2002, shall be
20 transferred to the restricted receipt account established in
21 section 1622. The Secretary of the Budget shall, within ten days
22 of the close of the fiscal year, advise the chairman and
23 minority chairman of the Appropriations Committee of the Senate
24 and the chairman and minority chairman of the Appropriations
25 Committee of the House of Representatives of the source and
26 amount of moneys transferred pursuant to this section.
27 Section 1796.1. Waiver provision not applicable.--The
28 appropriations in sections 1711, 1715, 1716, 1718, 1720 and
29 1721, for the Homeland Security Initiative or any component
30 thereof shall not be subject to the waiver provisions of section

1 621 of the act of April 9, 1929 (P.L.177, No.175), known as The
2 Administrative Code of 1929.
3 Section 1797. Construction with prior appropriation acts.--
4 Any appropriation in Subpart B of this part which is the same or
5 similar to any appropriation in the act of June 22, 2001
6 (P.L.979, No.6A), known as the General Appropriation Act of
7 2001, or the act of June 25, 2001 (P.L.1176, No.39A), entitled
8 "An act making an appropriation from a restricted revenue
9 account within the General Fund and from Federal augmentation
10 funds to the Pennsylvania Public Utility Commission," shall
11 replace that appropriation.
12 Section 1798. Deduction of expended appropriations under
13 prior law.--Any money which has been appropriated and expended
14 under the act of June 22, 2001 (P.L.979, No.6A), known as the
15 General Appropriation Act of 2001, or the act of June 25, 2001
16 (P.L.1176, No.39A), entitled "An act making an appropriation
17 from a restricted revenue account within the General Fund and
18 from Federal augmentation funds to the Pennsylvania Public
19 Utility Commission," shall be deducted from the corresponding
20 appropriation in this part.
21 PART XVIII
22 SPECIAL PROVISIONS FOR FEDERAL FUNDS
23 FOR 2002-2003
24 Section 1801. General Fund repository for Federal funds.--
25 All moneys received from the Federal Government as contributions
26 or supplements to the departments or agencies of the
27 Commonwealth or the programs herein provided shall be paid into
28 the General Fund.
29 Section 1802. Limitation on encumbering or spending Federal
30 funds.--Federal funds shall be encumbered or spent only to the

1 extent that such funds are estimated as being available during
2 the fiscal year of the Commonwealth.
3 Section 1803. Appropriation of prior unspent Federal
4 funds.--Any Federal money which has been previously appropriated
5 by the General Assembly and authorized or allocated by the
6 Federal Government but remains unspent from prior fiscal years
7 and will not be renewed for fiscal year 2002-2003 is hereby
8 appropriated.
9 Section 1804. Subgrants between Federal fund
10 appropriations.--Subgrants may be made between appropriations
11 without further approval of the General Assembly. The Secretary
12 of the Budget shall submit a list of subgrants to the chairman
13 and minority chairman of the Appropriations Committee of the
14 Senate and the chairman and minority chairman of the
15 Appropriations Committee of the House of Representatives
16 quarterly. No subgrant to a State agency, however, may be made
17 from a restricted receipt account without a specific
18 appropriation by the General Assembly.
19 Section 1805. Utilization of emergency Federal funds.--(a)
20 Federal funds available for costs and damages resulting from
21 natural disasters or civil disobedience may be added to an
22 appropriation contained in this act or to funds appropriated or
23 may be used for the purposes prescribed by the Federal
24 Government.
25 (b) In addition to the moneys appropriated by this act, all
26 moneys received from the Federal Government for the purpose of
27 disaster assistance or relief, or other moneys received as a
28 direct result of terrorist acts and moneys for homeland security
29 and defense, shall be paid into the General Fund and are hereby
30 appropriated out of the General Fund to the departments, boards,

1 commissions or agencies designated by the Governor.
2 (c) In the event of any emergency situation in which the
3 General Assembly cannot act in sufficient time, the Governor is
4 authorized through executive authorization to provide up to
5 $10,000,000 in Federal funds to alleviate the emergency
6 situation. For the purposes of this section, "emergency" is
7 defined as any situation in which there is a chance of or which
8 may result in substantial human suffering.
9 Section 1806. Transfer of funds from TANFBG to CCDFBG and
10 SSBG.--In accordance with Federal law which permits the transfer
11 of funds from the TANFBG to the CCDFBG and SSBG, the Department
12 of Public Welfare, upon approval of the Secretary of the Budget,
13 may make such transfers of funds provided that any such transfer
14 will not result in a deficit in any appropriation from which
15 funds are transferred. The Secretary of the Budget shall provide
16 notification of any such transfers to the chairman and the
17 minority chairman of the Appropriations Committee of the Senate
18 and the chairman and minority chairman of the Appropriations
19 Committee of the House of Representatives.
20 Section 1807. Transfer of LIHEAP funds.--(a) The Department
21 of Public Welfare, upon approval of the Secretary of the Budget,
22 may transfer up to 15% of any additional funds received for the
23 LIHEAP program either through an increase in the regular program
24 or a Presidential release of contingency funds, to the
25 Department of Community and Economic Development for the LIHEAP
26 - Weatherization Program. The Secretary of the Budget shall
27 provide notification of any such transfers to the chairman and
28 minority chairman of the Appropriations Committee of the Senate
29 and the chairman and minority chairman of the Appropriations
30 Committee of the House of Representatives.

1 (b) The Department of Public Welfare, upon approval of the
2 Secretary of the Budget, may transfer LIHEAP administrative
3 funds to the Department of Community and Economic Development
4 subject to any limitations under Federal law. The Secretary of
5 the Budget shall provide notification of any such transfer to
6 the chairman and minority chairman of the Appropriations
7 Committee of the Senate and the chairman and minority chairman
8 of the Appropriations Committee of the House of Representatives.
9 PART XIX
10 MISCELLANEOUS PROVISIONS FOR 2002-2003
11 Section 1901. Prior laws unaffected.--Except as provided in
12 section 253, this act is not intended to be inconsistent with or
13 to repeal any provision of any act enacted at this or any prior
14 session of the General Assembly regulating the purchase of
15 supplies, the ordering of printing and binding, the purchase,
16 maintenance and use of automobiles, the method of making
17 payments from the State Treasury for any purpose or the
18 functioning of any administrative department, board or
19 commission.
20 Section 1902. Compliance with other law before funds
21 available.--No appropriation made by this act to any department,
22 board, commission or agency of the Executive Department shall be
23 available unless and until the department, board, commission or
24 agency has complied with sections 615 and 616 of the act of
25 April 9, 1929 (P.L.177, No.175), known as The Administrative
26 Code of 1929.
27 Section 1903. Contracts prerequisite to encumbering or
28 committing funds.--Funds available to agencies, boards,
29 departments, commissions, or other governmental entities under
30 this act for the procurement of supplies, services or

1 construction shall not be available for payment of, or to be
2 committed to or encumbered for payment of, any such procurement
3 unless and until the agency, board, department or other
4 governmental entity has complied with all of the requirements
5 applicable to the procurement that are set out in 62 Pa.C.S.
6 (relating to procurement) and in the policies, procedures and
7 regulations instituted in accordance with that code.
8 Section 1904. Minority business set-asides.--(a) Each
9 department or other instrumentality of the Commonwealth listed
10 in Subpart A of Part II authorized to contract for buildings,
11 highways, commodities, equipment, supplies or services shall
12 report to the General Assembly all information pertinent to
13 anticipated procurement needs at the beginning of each fiscal

13 appropriation for that program or administration of the act.
14 (d) In addition to any funds specifically appropriated by
15 this act, all moneys transferred to the restricted receipt
16 account established in section 1622 are hereby appropriated from
17 the restricted receipt account to the Pennsylvania Emergency
18 Management Agency for the purpose of making volunteer fire
19 company and voluntary ambulance service grants. This
20 appropriation shall be allocated consistent with the definitions
21 and other provisions formerly contained in the act of June 22,
22 2000 (P.L.477, No.66), known as the Volunteer Fire Company and
23 Volunteer Ambulance Service Grant Act.
24 Section 1906. Lapsing of unused funds.--(a) Except as
25 otherwise provided by law or by this section, that part of all
26 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X,
27 XI, XII, XIII, XIV and XV unexpended, uncommitted or
28 unencumbered as of June 30, 2003, shall automatically lapse as
29 of that date.
30 (b) The appropriations in Part II to the Legislative

1 Department shall be continuing appropriations.
2 (c) The appropriations in sections 202, 208, 213, 214, 215,
3 218, 219, 223 and 225, for the Homeland Security Initiative or
4 any component thereof, shall not lapse to the General Fund and
5 any amounts unexpended or unencumbered on June 30, 2003, shall
6 be transferred to the restricted receipt account established in
7 section 1622. The Secretary of the Budget shall, within ten days
8 of the close of the fiscal year, advise the chairman and
9 minority chairman of the Appropriations Committee of the Senate
10 and the chairman and minority chairman of the Appropriations
11 Committee of the House of Representatives of the source and
12 amount of moneys transferred pursuant to this section.
13 Section 1906.1. Waiver provision not applicable.--The
14 appropriations in sections 202, 208, 213, 214, 215, 218, 219,
15 223 and 225, for the Homeland Security Initiative or any
16 component thereof, shall not be subject to the waiver provisions
17 of section 621 of the act of April 9, 1929 (P.L.177, No.175),
18 known as The Administrative Code of 1929.
19 Section 1907. Appellate courts appropriation contingency.--
20 The funds appropriated in Part II to the Supreme, Superior and
21 Commonwealth Courts for justice and judge expenses are
22 contingent upon a vouchered expense account plan being continued
23 by the Supreme Court.
24 Section 1908. Transfer of excess funds.--The Governor may
25 transfer any excess money in those funds receiving proceeds of
26 Commonwealth of Pennsylvania general obligation bonds in excess
27 of the amount necessary for the purposes for which the bonds
28 were issued to the appropriate sinking fund for payment of debt
29 service due on outstanding bonds. If such excess funds, together
30 with any available balance, exceed the amount of debt service

1 remaining to be paid, the funds shall be transferred to the
2 General Fund or to the appropriate special fund responsible for
3 such debt service.
4 Section 1909. Transfer of funds by the Supreme Court.--(a)
5 The Supreme Court may transfer any excess funds appropriated in
6 sections 281, 285, 286, 287 and 291 to the Judicial Department
7 in Part II to the Judicial Computer Augmentation Account during
8 the month of June 2003. No transfer may create or increase a
9 deficiency in the appropriation from which the transfer is made.
10 Whenever the Supreme Court makes a transfer under this
11 subsection, the Supreme Court shall give written notification to
12 the Secretary of the Budget and chairman and minority chairman
13 of the Senate Committee on Appropriations and the chairman and
14 the minority chairman of the House of Representatives Committee
15 on Appropriations ten days prior to any transfer which shall
16 also include certification that such transfer will not result in
17 a deficit in any appropriation.
18 (b) The Supreme Court may transfer funds appropriated in
19 section 281 between the line items in that section provided that
20 no transfer may create or increase a deficiency in the
21 appropriation from which the transfer is made. Whenever the
22 Supreme Court makes a transfer under this subsection, the
23 Supreme Court shall give written notification to the Secretary
24 of the Budget and the chairman and minority chairman of the
25 Senate Committee on Appropriations and the chairman and the
26 minority chairman of the House of Representatives Committee on
27 Appropriations ten days prior to any transfer which shall also
28 include certification that such transfer will not result in a
29 deficit in any appropriation.
30 Section 1910. Transfer from Hazardous Sites Cleanup Fund.--

1 The sum of $8,000,000 is transferred from the Hazardous Sites
2 Cleanup Fund to the Industrial Sites Cleanup Fund.
3 PART XX
4 EFFECTIVE DATE
5 Section 2001. Effective date.--This act shall take effect as
6 follows:
7 (1) Part XVII shall take effect immediately.
8 (2) This section shall take effect immediately.
9 (3) The remainder of this act shall take effect July 1,
10 2002, or immediately, whichever is later.
