Effective date. 15 The General Assembly of the Commonwealth of Pennsylvania 16 hereby enacts as follows: 17 PART I 18 GENERAL PROVISIONS 19 Section 101. Short title.--This act shall be known and may 20 be cited as the General Appropriation Act of 2001. 21 Section 102. Definitions.--The following words and phrases 22 when used in this act shall have the meanings given to them in 23 this section unless the context clearly indicates otherwise: 24 "Employees." Includes all directors, superintendents, bureau 25 or division chiefs, assistant directors, assistant 26 superintendents, assistant chiefs, experts, scientists, 27 engineers, surveyors, draftsmen, accountants, secretaries, 28 auditors, inspectors, examiners, analysts, statisticians, 29 marshals, clerks, stenographers, bookkeepers, messengers and 30 other assistants in any department, board or commission. 20010S0001B0799 - 5 -
1 "Expenses" and "maintenance." Includes all printing, binding 2 and stationery, food and forage, materials and supplies, 3 traveling expenses, training, motor vehicle supplies and 4 repairs, freight, express and cartage, postage, telephones and 5 telegraph rentals and toll charges, newspaper advertising and 6 notices, public advertising by or through any medium, fuel, 7 light, heat, power and water, minor construction and renovation, 8 repairs or reconstruction of equipment, buildings and 9 facilities, rent of real estate and equipment, premiums on 10 workers' compensation, insurance premiums on policies of 11 liability insurance, insurance premiums on medical payment 12 insurance and surety bonds for volunteer workers, premiums on 13 employee group life insurance and employee and retired employee 14 group hospital and medical insurance, payment of Commonwealth 15 share of Social Security taxes and unemployment compensation 16 costs for State employees, the purchase of replacement or 17 additional equipment and machinery and all other incidental 18 costs and expenses, including payment to the Department of 19 General Services of mileage and other charges for the use of 20 automobiles and rental payments for permanently assigned 21 automobiles and of expenses or costs of services incurred 22 through the Purchasing Fund. The term "expenses" also shall 23 include the medical costs for the treatment of inmates of State 24 institutions when the inmate must be transferred to an outside 25 hospital: Provided, That in no case shall the State institution 26 pay more for patient care than that provided under the State 27 medical assistance program. 28 Section 103. Women, Infants and Children Program. 30 Section 104. State appropriations.--The following sums set 20010S0001B0799 - 7 -
1 forth in this act, or as much thereof as may be necessary, are 2 hereby specifically appropriated from the General Fund to the 3 several hereinafter named agencies of the Executive, Legislative 4 and Judicial Departments of the Commonwealth for the payment of 5 salaries, wages or other compensation and travel expenses of the 6 duly elected or appointed officers and employees of the 7 Commonwealth, for the payment of fees for contractual services 8 rendered, for the purchase or rental of goods and services, 9 printing, public advertising by or through any medium, 10 equipment, land and buildings and for payment of any other 11 expenses, as provided by law or by this act, necessary for the 12 proper conduct of the duties, functions and activities and for 13 the purposes hereinafter set forth for the fiscal year beginning 14 July 1, 2001, and for the payment of bills incurred and 15 remaining unpaid at the close of the fiscal year ending June 30, 16 2001. 17 Section 105. Federal augmentation appropriations.--The 18 following Federal augmentation appropriations set forth in this 19 act, or as much thereof as may be necessary, are hereby 20 specifically appropriated from the Federal augmentation funds to 21 the several hereinafter named agencies of the Executive 22 Department of the Commonwealth for the payment of the expenses 23 of implementing and carrying out the programs stated herein for 24 the fiscal year beginning July 1, 2001, and for the payment of 25 bills incurred and remaining unpaid at the close of the fiscal 26 year ending June 30, 2001. Unless otherwise stated, the 27 appropriations include any carryovers from the prior fiscal 28 year. 29 Section 106. Block grants.--(a) Appropriation.--The 30 following sums set forth in this act, or as much thereof as may 20010S0001B0799 - 8 -
1 be necessary, are hereby specifically appropriated from the 2 block grant (BG) funds to the several hereinafter named agencies 3 of the Executive Department of the Commonwealth for the 4 purposes, and under the restrictions, for which the funds are 5 provided for the fiscal year beginning July 1, 2001. 6 (b) Small Communities Development Block Grant.--The Small 7 Communities Development Block Grant (SCDBG) is to assist small 8 cities and communities that have a high concentration of 9 impoverished citizens and substandard housing to expand their 10 low-income and moderate-income housing opportunities and to meet 11 community development needs. 12 (c) Community Services Block Grant.--The Community Services 13 Block Grant (CSBG) is to provide a range of services and 14 activities having a measurable and potentially major impact on 15 the causes of poverty in the community or those areas of the 16 community where poverty is a particularly acute problem. In 17 addition, new focus may be placed on the unemployed, both old 18 and new. Local agencies may lower their eligibility requirements 19 for recipients to three months to allow greater flexibility to 20 assure proper consideration of each recipient. 21 (d) Preventive Health and Health Services Block Grant.--The 22 Preventive Health and Health Services Block Grant (PHHSBG) is 23 for the provision of preventive health and other health services 24 related to emergency medical systems, health initiative grants, 25 comprehensive public health, hypertension, fluoridation, health 26 education, risk reduction, home health, rape crisis and domestic 27 violence services. 28 (e) Maternal and Child Health Services Block Grant.--The 29 Maternal and Child Health Services Block Grant (MCHSBG) is to 30 enable states to maintain and strengthen their leadership in 20010S0001B0799 - 9 -
1 planning, promoting, coordinating and evaluating health care for 2 pregnant women, mothers, infants and children, and children with 3 special health care needs, and in providing health services for 4 mothers and children who do not have access to adequate health 5 care. 6 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 7 Income Home Energy Assistance Block Grant (LIHEABG) is to help 8 lessen the impact of the high cost of energy on low-income 9 families and individuals, including energy efficiency grants for 10 low-income dwellings. No less than 15% of the LIHEABG funds 11 received shall be used for weatherization. LIHEABG funds 12 received pursuant to a Presidential release of contingency funds 13 shall be exempt from the 15% requirement. Unexpended 14 weatherization funds which would result in LIHEABG funds being 15 returned to the Federal Department of Health and Human Services 16 may be spent for assistance grants at the discretion of the 17 Secretary of the Budget. The Secretary of the Budget shall 18 notify the chairman and the minority chairman of the 19 Appropriations Committee of the Senate and the chairman and the 20 minority chairman of the Appropriations Committee of the House 21 of Representatives of the intent to reallocate any such funds 22 ten days prior to any reallocation. 23 (g) Social Services Block Grant.--The Social Services Block 24 Grant (SSBG) is for the provision of social services to eligible 25 persons. 26 (h) Mental Health Services Block Grant.--The Mental Health 27 Services Block Grant (MHSBG) provides funds for the provision of 28 services to adults with serious mental illness or children with 29 serious emotional disturbance. 30 (i) Substance Abuse Block Grant.--The Substance Abuse Block 20010S0001B0799 - 10 -
1 Grant (SABG) provides funds to establish and maintain programs 2 to combat alcohol and drug abuse. 3 (j) Child Care and Development Fund Block Grant.--The Child 4 Care and Development Fund Block Grant (CCDFBG) is for the 5 provision of direct child care or to increase the availability 6 of child care for low-income families. 7 (k) Temporary Assistance for Needy Families Block Grant.-- 8 The Temporary Assistance for Needy Families Block Grant (TANFBG) 9 provides funds for the provision of cash grants, child care, 10 training and support services, child welfare and administration 11 for eligible families and individuals. 12 PART II 13 GENERAL FUND AND FEDERAL APPROPRIATIONS 14 FOR 2001-2002 15 SUBPART A 16 EXECUTIVE DEPARTMENT 17 Section 201. Governor.--The 18 following amounts are appropriated to 19 the Governor: Federal State 20 For the Office of the Governor: 21 including the maintenance of the 22 Governor's Home, the expense of 23 entertainment of official guests and 24 members of the General Assembly and 25 the Judiciary, participation in the 26 Governor's Conference, the expenses of 27 the Executive Board and the payment of 28 traveling expenses of persons other 29 than employees of the Commonwealth 30 appointed by the Governor to represent 20010S0001B0799 - 11 -

Juror cost 5 reimbursement.--The following amounts 6 are appropriated for juror cost 7 reimbursement: Federal State 8 For juror cost reimbursement. 9 State appropriation........ 1,469,000 10 Section 292. County court 11 reimbursement.--The following amounts 12 are appropriated for court costs: Federal State 13 For payment to counties as 14 reimbursement for costs incurred by 15 counties in the administration and 16 operation of courts of common pleas 17 during calendar year 2000. 18 Reimbursement shall be provided on the 19 following basis: for each common pleas 20 court judge authorized position, 21 whether filled or vacant within a 22 judicial district, $70,000 per 23 authorized position shall be provided. 24 Judicial districts comprising more 25 than one county shall be entitled to 26 receive $70,000 per authorized common 27 pleas court judge position; the amount 28 payable to each county shall be 29 determined by the proportion of the 30 individual county's population in 20010S0001B0799 - 167 -
1 relation to the population of the 2 entire judicial district. No county 3 shall be reimbursed for costs above 4 the actual direct costs, excluding 5 capital outlays, incurred by them for 6 the operation of the courts of common 7 pleas. For the purposes of 8 reimbursement for common pleas court 9 judge authorized positions, no county 10 shall receive less than 75% of the 11 actual reimbursement for court costs 12 provided to them from funds 13 appropriated for the fiscal year July 14 1, 1980, to June 30, 1981. 15 All payments for reimbursement 16 shall be made to the county treasurer 17 and, in cities of the first class 18 coterminous with counties of the first 19 class, to the city treasurer. 20 State appropriation........ 31,356,000 21 PART III 22 RESTRICTED RECEIPT ACCOUNTS 23 Section 301. General provisions.--The Secretary of the 24 Budget may create the restricted receipt accounts set forth in 25 this part for the purpose of administering Federal grants only 26 for the purposes herein designated during the fiscal year July 27 1, 2001, through June 30, 2002. 28 Section 302. Pennsylvania Emergency Management Agency.--The 8 following restricted receipt account may be established for the 9 Pennsylvania Emergency Management Agency: 10 (1) "Receipts from Federal Government - Disaster Relief - 11 Disaster Relief Assistance to State and Political Subdivisions." 12 Section 308. Pennsylvania Historical and Museum 13 Commission.--The following restricted receipt account may be 14 established for the Pennsylvania Historical and Museum 15 Commission: 16 (1) "Federal Grant - Historical Preservation Act of 1966." 17 PART IV 18 SPECIAL PROVISIONS FOR FEDERAL FUNDS 19 FOR 2001-2002 20 Section 401. General Fund repository for Federal funds.--All 21 moneys received from the Federal Government as contributions or 22 supplements to the departments or agencies of the Commonwealth 23 or the programs herein provided shall be paid into the General 24 Fund. 25 Section 402. Limitation on encumbering or spending Federal 26 funds.--Federal funds shall be encumbered or spent only to the 27 extent that such funds are estimated as being available during 28 the fiscal year of the Commonwealth. 29 Section 403. Appropriation of prior unspent Federal funds.-- 30 Any Federal money which has been previously appropriated by the 20010S0001B0799 - 170 -
1 General Assembly and authorized or allocated by the Federal 2 Government but remains unspent from prior fiscal years and will 3 not be renewed for fiscal year 2001-2002 is hereby appropriated. 4 Section 404. Subgrants between Federal fund 5 appropriations.--With the exception of Federal money received 6 under SSBG, subgrants may be made between appropriations without 7 further approval of the General Assembly. The Secretary of the 8 Budget shall submit a list of subgrants to the chairman and 9 minority chairman of the Appropriations Committee of the Senate 10 and the chairman and minority chairman of the Appropriations 11 Committee of the House of Representatives quarterly. No subgrant 12 to a State agency, however, may be made from a restricted 13 receipt account without a specific appropriation by the General 14 Assembly. 15 Section 405. Utilization of emergency Federal funds.--(a) 16 Federal funds available for costs and damages resulting from 17 natural disasters or civil disobedience may be added to an 18 appropriation contained in this act or to funds appropriated or 19 may be used for the purposes prescribed by the Federal 20 Government. 21 (b) In addition to the moneys appropriated by this act, all 22 moneys received from the Federal Government for the purpose of 23 disaster assistance or relief shall be paid into the General 24 Fund and are hereby appropriated out of the General Fund to the 25 departments, boards, commissions or agencies designated by the 26 Governor. 27 (c) In the event of any emergency situation in which the 28 General Assembly cannot act in sufficient time, the Governor is 29 authorized through executive authorization to provide up to 30 $10,000,000 in Federal funds to alleviate the emergency 20010S0001B0799 - 171 -
1 situation. For the purposes of this section, "emergency" is 2 defined as any situation in which there is a chance of or which 3 may result in substantial human suffering. 4 Section 406. Transfer of funds from TANFBG to CCDFBG and 5 SSBG.--In accordance with Federal law which permits the transfer 6 of funds from the TANFBG to the CCDFBG and SSBG, the Department 7 of Public Welfare, upon approval of the Secretary of the Budget, 8 may make such transfers of funds provided that any such transfer 9 will not result in a deficit in any appropriation from which 10 funds are transferred. The Secretary of the Budget shall provide 11 notification of any such transfers to the chairman and the 12 minority chairman of the Appropriations Committee of the Senate 13 and the chairman and minority chairman of the Appropriations 14 Committee of the House of Representatives ten days prior to any 15 transfer which shall also include certification that such 16 transfer will not result in a deficit in any appropriation. 17 PART V 18 MISCELLANEOUS PROVISIONS FOR 2001-2002 19 Section 501. Prior laws unaffected.--Except as provided in 20 section 253, this act is not intended to be inconsistent with or 21 to repeal any provision of any act enacted at this or any prior 22 session of the General Assembly regulating the purchase of 23 supplies, the ordering of printing and binding, the purchase, 24 maintenance and use of automobiles, the method of making 25 payments from the State Treasury for any purpose or the 26 functioning of any administrative department, board or 27 commission. 28 Section 502. Compliance with other law before funds 29 available.--No appropriation made by this act to any department, 30 board, commission or agency of the Executive Department shall be 20010S0001B0799 - 172 -
1 available unless and until the department, board, commission or 2 agency has complied with sections 615 and 616 of the act of 3 April 9, 1929 (P.L.177, No.175), known as The Administrative 4 Code of 1929. 5 Section 503. Contracts prerequisite to encumbering or 6 committing funds.--Funds available to agencies, boards, 7 departments, commissions, or other governmental entities under 8 this act for the procurement of supplies, services or 9 construction shall not be available for payment of, or to be 10 committed to or encumbered for payment of, any such procurement 11 unless and until the agency, board, department or other 12 governmental entity has complied with all of the requirements 13 applicable to the procurement that are set out in 62 Pa.C.S. 14 (relating to procurement) and in the policies, procedures and 15 regulations instituted in accordance with that code. 16 Section 504. Minority business set-asides.--(a) Each 17 department or other instrumentality of the Commonwealth listed 18 in Subpart A of Part II authorized to contract for buildings, 19 highways, commodities, equipment, supplies or services shall 20 report to the General Assembly all information pertinent to 21 anticipated procurement needs at the beginning of each fiscal 22 year and each fiscal quarter thereafter. 23 (b) As used in this section, the term "minority business" 24 means a minority business enterprise as defined in the act of 25 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 26 Minority Business Development Authority Act. 27 Section 505. Appropriation of funds from miscellaneous 28 sources.--(a) In addition to the amounts appropriated by this 29 act, moneys received in payment for food and household supplies 30 furnished to employees and other persons, except inmates, by an 20010S0001B0799 - 173 -
1 institution, and moneys received from the proceeds from the sale 2 of any products of the soil, meats, livestock, timber or other 3 materials sold by the department shall be paid into the General 4 Fund and are hereby appropriated out of the General Fund to the 5 several respective institutions for the operation and 6 maintenance of the institutions. 7 (b) In addition to the amounts appropriated by this act, all 8 moneys received from any other source, except the Federal 9 Government, as contributions for the programs provided herein or 10 as payment for services or materials furnished by one 11 institution to another, except those collections designated as 12 revenues, shall be paid into the General Fund and are hereby 13 appropriated out of the General Fund for the purposes of the 14 respective appropriations. 15 (c) In addition to any funds specifically appropriated by 16 this act, all moneys received by a department or agency of the 17 Commonwealth from any other sources, except the Federal 18 Government, as contributions or supplements to the department or 19 agency for a program or administration of an act included in 20 this act shall be paid into the General Fund and credited to the 21 appropriation for that program or administration of the act. 22 Section 506. Lapsing of unused funds.--(a) Except as 23 otherwise provided by law or by this section, that part of all 24 appropriations in Parts II and III unexpended, uncommitted or 25 unencumbered as of June 30, 2002, shall automatically lapse as 26 of that date. 27 (b) The appropriations in sections 251, 253, 254, 255, 256, 28 257, 258, 259, 260, 261, 262, 263 and 264 shall be continuing 29 appropriations. 30 (c) All appropriations to the House of Representatives from 20010S0001B0799 - 174 -
1 any prior General Fund Appropriation Act which are unexpended, 2 uncommitted or unencumbered shall automatically lapse on June 3 30, 2001. 4 Section 507. Appellate courts appropriation contingency.-- 5 The funds appropriated in Part II to the Supreme, Superior and 6 Commonwealth Courts for justice and judge expenses are 7 contingent upon a vouchered expense account plan being continued 8 by the Supreme Court. 9 Section 508. Transfer of excess funds.--The Governor may 10 transfer any excess money in those funds receiving proceeds of 11 Commonwealth of Pennsylvania general obligation bonds in excess 12 of the amount necessary for the purposes for which the bonds 13 were issued to the appropriate sinking fund for payment of debt 14 service due on outstanding bonds. If such excess funds, together 15 with any available balance, exceed the amount of debt service 16 remaining to be paid, the funds shall be transferred to the 17 General Fund or to the appropriate special fund responsible for 18 such debt service. 19 Section 509. Transfer of funds by the Supreme Court.--(a) 20 The Supreme Court may transfer any excess funds appropriated in 21 sections 281, 285, 286, 287, 290 and 291 to the Judicial 22 Department in Part II to the Judicial Computer Augmentation 23 Account during the month of June 2002. No transfer may create or 24 increase a deficiency in the appropriation from which the 25 transfer is made. Whenever the Supreme Court makes a transfer 26 under this subsection, the Supreme Court shall give written 27 notification to the Secretary of the Budget and chairman and 28 minority chairman of the Senate Committee on Appropriations and 29 the chairman and the minority chairman of the House of 30 Representatives Committee on Appropriations ten days prior to 20010S0001B0799 - 175 -
1 any transfer which shall also include certification that such 2 transfer will not result in a deficit in any appropriation. 3 (b) The Supreme Court may transfer funds appropriated in 4 section 281 between the line items in that section provided that 5 no transfer may create or increase a deficiency in the 6 appropriation from which the transfer is made. Whenever the 7 Supreme Court makes a transfer under this subsection, the 8 Supreme Court shall give written notification to the Secretary 9 of the Budget and the chairman and minority chairman of the 10 Senate Committee on Appropriations and the chairman and the 11 minority chairman of the House of Representatives Committee on 12 Appropriations ten days prior to any transfer which shall also 13 include certification that such transfer will not result in a 14 deficit in any appropriation. 15 Section 510. Transfer from Capital Debt Fund.--The sum of 16 $20,000,000 is transferred from the Capital Debt Fund to the 17 Capital Facilities Fund. 18 Section 511. Transfer from the SciTech and Technology 19 Scholarship Program.--The sum of $20,000,000 is transferred from 20 the SciTech and Technology Scholarship Program in the 21 Pennsylvania Higher Education Assistance Agency to the General 22 Fund appropriations from which the funds were originally 23 transferred and shall lapse. 24 PART VI 25 EFFECTIVE DATE 26 Section 601.
