HOUSE RESOLUTION

No. 346 Session of 2001


        INTRODUCED BY LYNCH, BARD, BARRAR, CAPPELLI, CLARK, COLEMAN,
           CREIGHTON, GABIG, GEIST, GODSHALL, GRUCELA, HERSHEY, JAMES,
           LEH, MELIO, PETRARCA, ROHRER, SAINATO, SEMMEL, SHANER,
           STABACK, STEELMAN, E. Z. TAYLOR, TIGUE, TRELLO, WILT AND
           WOJNAROSKI, OCTOBER 31, 2001

        REFERRED TO COMMITTEE ON RULES, OCTOBER 31, 2001

                            A CONCURRENT RESOLUTION

     1  Directing a select committee to study the ramifications of
     2     repealing The Local Tax Enabling Act and taxation provisions
     3     of local government codes; and authorizing local government
     4     units to devise their own systems of taxation.

     5     WHEREAS, Taxpayers across this Commonwealth are in desperate
     6  need of local tax reform; and
     7     WHEREAS, Local officials are in the best position to know the
     8  desires of their residents for services and the ability of their
     9  residents to pay local taxes; and
    10     WHEREAS, Legislation may be proposed to repeal the act of
    11  December 31, 1965 (P.L.1257, No.511), known as The Local Tax
    12  Enabling Act, and the taxation provisions of local government
    13  codes; therefore be it
    14     RESOLVED (the Senate concurring), That the General Assembly
    15  form a select committee to study the ramifications of repealing
    16  The Local Tax Enabling Act and taxation provisions of local
    17  government codes and authorizing local government units to


     1  devise their own systems of taxation; and be it further
     2     RESOLVED, That the committee be comprised of six members. One
     3  member shall be appointed by each of the following:
     4         (1)  the President pro tempore of the Senate;
     5         (2)  the Majority Leader of the Senate;
     6         (3)  the Minority Leader of the Senate;
     7         (4)  the Speaker of the House of Representatives;
     8         (5)  the Majority Leader of the House of Representatives;
     9     and
    10         (6)  the Minority Leader of the House of Representatives;
    11  and be it further
    12     RESOLVED, That these appointments be made within 30 days of
    13  adoption of this resolution by the Senate and the House of
    14  Representatives; and be it further
    15     RESOLVED, That the select committee hold hearings, take
    16  testimony and make its investigations at such places as it deems
    17  necessary in this Commonwealth. Each member of the select
    18  committee shall have power to administer oaths and affirmations
    19  to witnesses appearing before the select committee; and be it
    20  further
    21     RESOLVED, That the select committee submit a report with
    22  findings and recommendations to the Finance Committee of the
    23  Senate and the Finance Committee of the House of
    24  Representatives. The report of the select committee shall be
    25  submitted within six months of adoption of this resolution by
    26  the Senate and the House of Representatives.
