                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for passing stopped authorized and
     3     emergency vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding section to read:
     8  § 3329.  Passing stopped authorized and emergency vehicles.
     9     (a)  General rule.--Upon the immediate approach of an
    10  authorized vehicle or emergency vehicle parked or standing on or
    11  within 12 feet of a highway and making use of visual signals
    12  meeting the requirements of Subchapter D of Chapter 45 (relating
    13  to equipment of authorized and emergency vehicles) and standards
    14  set forth in regulations adopted by the department, the driver
    15  of every other vehicle shall:
    16         (1)  Move the vehicle into a lane that is not the lane
    17     nearest the authorized vehicle or emergency vehicle and
    18     continue traveling in that lane until safely clear of the

     1     authorized vehicle or emergency vehicle. This paragraph shall
     2     apply only if the highway has at least two lanes for traffic
     3     proceeding in the direction of the approaching vehicle and if
     4     the approaching vehicle may change lanes safely and without
     5     interfering with any vehicular traffic.
     6         (2)  Slow the vehicle, maintaining a safe speed for
     7     traffic conditions and operate the vehicle at a reduced speed
     8     until completely past the authorized vehicle or emergency
     9     vehicle. This paragraph shall apply only if the highway has
    10     only one lane for traffic proceeding in the direction of the
    11     approaching vehicle or if the approaching vehicle may not
    12     change lanes safely and without interfering with any
    13     vehicular traffic.
    14     (b)  Fine.--Any driver who violates this section shall, upon
    15  conviction, be sentenced to pay a fine of not less than $30 nor
    16  more than $300.
    17     (c)  Suspension of operating privilege.--The department shall
    18  suspend the operating privilege of any driver for not less than
    19  90 days nor more than one year upon receiving a certified record
    20  of the driver's conviction under this section and if the
    21  violation resulted in damage to another's property. The license
    22  shall be surrendered in accordance with section 1540 (relating
    23  to surrender of license).
    24     Section 2.  This act shall take effect in 60 days.
