                                     AN ACT

     1  Providing for toxic mold testing of schools; and making an
     2     appropriation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Toxic Mold
     7  Testing and Removal Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Health of the Commonwealth.
    13     "School."  A public, private or parochial elementary or
    14  secondary school.
    15     "Toxic mold."  Stachybotrys, Memnoniella or any other mold

     1  containing health-threatening mycotoxins.
     2  Section 3.  Testing and reporting.
     3     (a)  Testing.--The department shall test schools triannually
     4  to determine the presence of toxic mold.
     5     (b)  Report.--The department shall publish in the
     6  Pennsylvania Bulletin an annual report of the results of testing
     7  conducted under subsection (a).
     8  Section 4.  Removal.
     9     The department shall be responsible for 25% of the toxic mold
    10  removal costs when toxic mold is discovered as a result of
    11  testing conducted pursuant to this act.
    12  Section 5.  Appropriation.
    13     The General Assembly shall annually appropriate money to the
    14  Department of Health in an amount sufficient to fully carry out
    15  the provisions of this act.
    16  Section 6.  Effective date.
    17     This act shall take effect in 60 days.
