AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," further defining "eligibility test";
6 and further providing for establishment of Education Support
7 Services Program.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The definition of "eligibility test" in section
11 1501-C of the act of March 10, 1949 (P.L.30, No.14), known as
12 the Public School Code of 1949, amended June 29, 2002 (P.L.524,
13 No.88), is amended to read:
14 Section 1501-C. Definitions.
15 The following words and phrases when used in this article
16 shall have the meanings given to them in this section unless the
17 context clearly indicates otherwise:

19 "Eligibility test." The Pennsylvania System of School
20 Assessment or a commercially prepared, standardized achievement
1 test or nonstandardized test approved by the Department of
2 Education. A list of approved tests under this article shall be
3 published annually in the Pennsylvania Bulletin.

5 Section 2. Section 1502-C(b) of the act, added May 17, 2001
6 (P.L.4, No.4), is amended to read:
7 Section 1502-C. Establishment of program.

9 (b) Eligibility.--The department shall utilize [the
10 Pennsylvania System of School Assessment test or other test
11 results] eligibility tests to identify eligible students under
12 this article. Scores used to determine eligible students in each
13 grade shall be published annually in the Pennsylvania Bulletin.

15 Section 3. This act shall take effect in 60 days.
