                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further defining "qualified motor vehicle" for
     3     purposes of the motor carriers road tax.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definition of "qualified motor vehicle" in
     7  section 2101.1 of Title 75 of the Pennsylvania Consolidated
     8  Statutes is amended to read:
     9  § 2101.1.  Definitions.
    10     The following words and phrases when used in this chapter and
    11  in Chapter 96 (relating to motor carriers road tax) shall have
    12  the meanings given to them in this section unless the context
    13  clearly indicates otherwise:
    14     * * *
    15     "Qualified motor vehicle."  A motor vehicle[, other than a
    16  recreational vehicle,] which is used, designed or maintained for
    17  transportation of persons or property and:

     1         (1)  Having two axles and a gross weight or registered
     2     gross weight exceeding 26,000 pounds.
     3         (2)  Having three or more axles regardless of weight.
     4         (3)  Used in combination, when the gross weight or
     5     registered gross weight of the combination exceeds 26,000
     6     pounds.
     7  If there is no registered gross weight, then the gross vehicle
     8  weight rating (GVWR) or gross combination weight rating (GCWR)
     9  of the motor vehicle shall be used. The term shall not include a
    10  recreational vehicle, a truck or truck tractor registered under
    11  section 1340 (relating to antique, classic and collectible
    12  plates) or a mass transit vehicle registered under section 1340.
    13     Section 2.  This act shall take effect in 60 days.
