                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for personal
     4     needs allowance deduction for medical assistance eligible
     5     persons in nursing facilities.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, is amended by adding a section to
    10  read:
    11     Section 443.7.  Personal Needs Allowance Deduction for
    12  Medical Assistance Eligible Persons in Nursing Facilities.--A
    13  personal needs allowance of not less than $60 per month, for
    14  clothing and other personal needs, shall be deducted from a
    15  medical assistance eligible person's gross income, as defined by


     1  departmental regulation, for purposes of determining the amount
     2  that person must pay toward the cost of skilled health care and
     3  intermediate services or intermediate care while residing in a
     4  nursing facility.
     5     Section 2.  This act shall take effect in 60 days.
