                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, defining "mobile phone"; prohibiting the use of
     3     mobile phone in school zone; and imposing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 102 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition to read:
     8  § 102.  Definitions.
     9     Subject to additional definitions contained in subsequent
    10  provisions of this title which are applicable to specific
    11  provisions of this title, the following words and phrases when
    12  used in this title shall have, unless the context clearly
    13  indicates otherwise, the meanings given to them in this section:
    14     * * *
    15     "Mobile phone."  Any telecommunications device that receives
    16  an analog signal or digital signal, or both, and that is
    17  designed for handheld use.

     1     Section 2.  Title 75 is amended by adding a section to read:
     2  § 3315.  Prohibiting the use of mobile phone in school zone.
     3     (a)  General rule.--No driver shall operate a vehicle or
     4  school bus within a school zone when the lights are illuminated
     5  with intermittent flashes while using a mobile phone.
     6     (b)  Exceptions.--This section shall not apply to:
     7         (1)  Law enforcement officers and operators of emergency
     8     vehicles when on duty and acting in their official
     9     capacities.
    10         (2)  Persons who are reporting an accident or emergency.
    11     (c)  Posting.--All school zones shall be posted with signs
    12  designated by the department.
    13     (d)  Penalty.--Any person who violates subsection (a) commits
    14  a summary offense and shall, upon conviction, be sentenced to
    15  pay a fine of $100. A conviction under this section shall not
    16  constitute a moving violation unless the offense involves an
    17  accident.
    18     Section 3.  This act shall take effect in 60 days.
