                                     AN ACT

     1  Authorizing the incurring of indebtedness, with the approval of
     2     the electors, of $20,000,000 to provide additional funding
     3     for the rehabilitation and renovation of senior centers; and
     4     establishing the Senior Center Grant Program Fund.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Senior Center
     9  Grant Program Fund Act.
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Department."  The Department of Aging of the Commonwealth.


     1     "Fund."  The Senior Center Grant Program Fund established in
     2  section 8.
     3     "Program."  The Senior Center Grant Program under the act of
     4  December 17, 1984 (P.L.999, No.201), known as the Senior Center
     5  Grant Program Act.
     6  Section 3.  Referendum.
     7     The question of incurring indebtedness of $20,000,000 to
     8  provide additional funding for the rehabilitation and renovation
     9  of senior center facilities shall be submitted to the electors
    10  at the next primary, municipal or general election following the
    11  effective date of this act.
    12  Section 4.  Certification.
    13     The Secretary of the Commonwealth shall forthwith certify the
    14  question to the county boards of election.
    15  Section 5.  Form of question.
    16     The question shall be in substantially the following form:
    17         Do you favor the incurring of indebtedness by the
    18     Commonwealth of $20,000,000 to provide funding through the
    19     Department of Aging for the rehabilitation and renovation of
    20     senior center facilities?
    21  Section 6.  Conduct of referendum.
    22     The election shall be conducted in accordance with the act of
    23  act of June 3, 1937 (P.L.1333, No.320), known as the
    24  Pennsylvania Election Code, except that the time limits for
    25  advertisement of notice of the election may be waived as to the
    26  question.
    27  Section 7.  Use of bond proceeds.
    28     (a)  General rule.--Proceeds of borrowing shall be used to
    29  provide funding to senior centers to promote the purposes of the
    30  act of December 17, 1984 (P.L.999, No.201), known as the Senior

     1  Center Grant Program Act.
     2     (b)  Request for proposal.--The department shall prepare an
     3  annual request for proposal for the purpose of providing funding
     4  described under subsection (a). Annual funding shall at a
     5  minimum equal half the total amount that would have been
     6  necessary to fund the requests for senior center grants in the
     7  preceding fiscal year.
     8  Section 8.  Senior Center Grant Program Fund.
     9     (a)  Fund established.--There is hereby established in the
    10  State Treasury a restricted receipt account to be known as the
    11  Senior Center Grant Program Fund to provide moneys necessary to
    12  implement the provisions of this act. The fund shall be
    13  administered by the department, and moneys in the fund are
    14  appropriated to the department on a continuing nonlapsing basis.
    15     (b)  Source of fund.--The fund shall consist of:
    16         (1)  All proceeds from the sale of bonds as approved
    17     under this act.
    18         (2)  Appropriations under subsection (c).
    19         (3)  Interest earned by the fund.
    20     (c)  Appropriations.--Upon adoption of the General Fund
    21  budget, the Department of Revenue shall be authorized to
    22  transmit the appropriated funds which the Department of Aging
    23  designates for the program in the State Lottery Fund to the
    24  State Treasurer to be deposited in the Senior Center Grant
    25  Program Fund.
    26  Section 9.  Effective date.
    27     This act shall take effect immediately.
