                                     AN ACT

     1  Amending Title 27 (Environmental Resources) of the Pennsylvania
     2     Consolidated Statutes, further providing for the
     3     Environmental Stewardship Fund and for extension of fees.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 6104(b)(1) and 6112(b) of Title 27 of
     7  the Pennsylvania Consolidated Statutes are amended to read:
     8  § 6104.  Fund.

    10     (b)  Sources.--
    11         (1)  Money appropriated by the General Assembly, interest
    12     earned by the fund, penalties, money received from the
    13     Federal Government or other sources and money received from
    14     the [fee] fees established under section 6112(b) (relating to
    15     extension of fees) shall be deposited in the fund. Moneys
    16     appropriated by the General Assembly to the fund shall be
    17     transferred on a quarterly basis in increments of at least
    18     20%.

     4     (b)  [Fee] Fees established.--
     5         (1)  Each operator of a municipal waste landfill shall
     6     pay, in the same manner prescribed in section 701 of the
     7     Municipal Waste Planning, Recycling and Waste Reduction Act,
     8     an amount equal to 25¢ per ton of weighted waste or 25¢ per
     9     three cubic yards of volume-measured waste for all solid
    10     waste received at the landfill. These fees shall be paid to
    11     the State Treasury and deposited into the fund.
    12         (2)  Each operator of a municipal waste landfill and
    13     resource recovery facility shall pay, in addition to the fee
    14     prescribed in section 701 of the Municipal Waste Planning,
    15     Recycling and Waste Reduction Act, a disposal fee of $5 per
    16     ton for all solid waste processed at the municipal waste
    17     landfill and resource recovery facility. The fee established
    18     under this paragraph shall be paid to the State Treasurer and
    19     deposited into the fund.
    20     Section 2.  This act shall take effect in 60 days.
