AN ACT 1 Amending the act of May 23, 1945 (P.L.913, No.367), entitled, as 2 amended, "An act relating to and regulating the practice of 3 the profession of engineering, including civil engineering, 4 mechanical engineering, electrical engineering, mining 5 engineering and chemical engineering, the profession of land 6 surveying and the profession of geology and constituent parts 7 and combinations thereof as herein defined; providing for the 8 licensing and registration of persons practicing said 9 profession, and the certification of engineers-in-training 10 and surveyors-in-training, and the suspension and revocation 11 of said licenses, registrations and certifications for 12 violation of this act; prescribing the powers and duties of 13 the State Registration Board for Professional Engineers, Land 14 Surveyors and Geologists, the Department of State and the 15 courts; prescribing penalties; and repealing existing laws," 16 further providing for THE APPOINTMENT OF LICENSED GEOLOGISTS <-- 17 TO THE BOARD AND FOR THE procedure for licensing as A <-- 18 professional land surveyor. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. Section 4.3(b)(1) of the act of May 23, 1945 <-- 22 (P.L.913, No.367), known as the Engineer, Land Surveyor and 23 Geologist Registration Law, added December 19, 1990 (P.L.782,
1 No.192), is amended and the subsection is amended by adding a 2 clause to read: 3 SECTION 1. SECTION 4.1(A) OF THE ACT OF MAY 23, 1945 <-- 4 (P.L.913, NO.367), KNOWN AS THE ENGINEER, LAND SURVEYOR AND 5 GEOLOGIST REGISTRATION LAW, AMENDED DECEMBER 16, 1992 (P.L.1151, 6 NO.151), IS AMENDED TO READ: 7 SECTION 4.1. STATE REGISTRATION BOARD FOR PROFESSIONAL 8 ENGINEERS, LAND SURVEYORS AND GEOLOGISTS.--(A) THERE IS HEREBY 9 ESTABLISHED WITHIN THE DEPARTMENT OF STATE THE STATE 10 REGISTRATION BOARD FOR PROFESSIONAL ENGINEERS, LAND SURVEYORS 11 AND GEOLOGISTS. THE BOARD SHALL CONSIST OF THE COMMISSIONER OF 12 PROFESSIONAL AND OCCUPATIONAL AFFAIRS, THREE MEMBERS APPOINTED 13 BY THE GOVERNOR WHO SHALL BE PERSONS REPRESENTING THE PUBLIC AT 14 LARGE AND NINE MEMBERS APPOINTED BY THE GOVERNOR, FIVE OF WHOM 15 SHALL BE REGISTERED PROFESSIONAL ENGINEERS, TWO OF WHOM SHALL BE 16 REGISTERED PROFESSIONAL LAND SURVEYORS AND TWO OF WHOM SHALL BE 17 REGISTERED PROFESSIONAL GEOLOGISTS. ANY LAND SURVEYOR [AND 18 GEOLOGIST] APPOINTED TO SERVE ON THE BOARD SHALL HAVE RECEIVED 19 THE [RESPECTIVE] LAND SURVEYOR LICENSE [OR GEOLOGIST LICENSE] 20 UPON THE PASSAGE OF THE APPROPRIATE [EXAMINATIONS: PROVIDED, 21 HOWEVER, THAT FOR THE INITIAL BOARD APPOINTMENTS, THE TWO 22 PROFESSIONAL GEOLOGIST MEMBERS NEED NOT BE LICENSED BY 23 EXAMINATION AT THE TIME OF APPOINTMENT BUT MUST HAVE SATISFIED 24 THE EDUCATION AND EXPERIENCE REQUIREMENTS OF THIS ACT FOR 25 LICENSURE AS A PROFESSIONAL GEOLOGIST.] EXAMINATION. ANY 26 GEOLOGIST LICENSED UNDER SECTION 4.4 OF THIS ACT SHALL BE 27 ELIGIBLE FOR APPOINTMENT TO THE BOARD. THE PROFESSIONAL MEMBERS 28 OF THE BOARD SHALL BE SO SELECTED THAT NOT MORE THAN TWO OF THEM 29 SHALL SPECIALIZE IN ANY ONE OF THE FIVE MAJOR DISCIPLINES OF 30 ENGINEERING: CIVIL, MINING AND METALLURGICAL, MECHANICAL, 20010H2207B4559 - 2 -
1 ELECTRICAL AND CHEMICAL. EACH MEMBER OF THE BOARD SHALL BE A 2 CITIZEN OF THE UNITED STATES AND A RESIDENT OF THIS 3 COMMONWEALTH. EACH PROFESSIONAL MEMBER SHALL HAVE BEEN ENGAGED 4 IN THE PRACTICE OF THE RESPECTIVE PROFESSION FOR AT LEAST TEN 5 YEARS AND SHALL HAVE BEEN IN RESPONSIBLE CHARGE OF WORK FOR AT 6 LEAST FIVE YEARS. 7 * * * 8 SECTION 2. SECTION 4.3(B)(1) OF THE ACT, ADDED DECEMBER 19, 9 1990 (P.L.782, NO.192), IS AMENDED AND THE SUBSECTION IS AMENDED 10 BY ADDING A CLAUSE TO READ: 11 Section 4.3. Procedure for Licensing as Professional Land 12 Surveyor.--* * * 13 (b) (1) An applicant for the surveyor-in-training 14 certificate shall show satisfactory evidence of: 15 (i) graduation from an approved civil engineering curriculum 16 of at least four years, including no less than ten credit hours 17 instruction in surveying; 18 (ii) six or more years of progressive experience in 19 surveying and knowledge, skill and education deemed equivalent, 20 in accordance with board regulation, to graduation from an 21 approved curriculum in land surveying or civil engineering; or 22 (iii) an associate's degree in an approved surveying 23 technology curriculum. 24 * * * 25 (4) An applicant who is a surveying student who has 26 completed two or more years of an approved curriculum may, 27 subject to board approval, sit for the examination; but such 28 student shall not be eligible for certification until that 29 student shows proof of graduation. 30 * * * 20010H2207B4559 - 3 -
