AN ACT
1 Amending the act of June 25, 1999 (P.L.205, No.27), entitled, as
2 amended, "An act authorizing the Department of General
3 Services, with the approval of the Governor, to convey to
4 East Allen Township, Northampton County, certain land situate
5 in East Allen Township, Northampton County, and to convey to
6 the trustees of the University of Pittsburgh certain land
7 situate in the City of Pittsburgh, Allegheny County;
8 authorizing and directing the State Armory Board of the
9 Department of Military and Veterans Affairs and the
10 Department of General Services, with the approval of the
11 Governor, to convey to the Historical and Genealogical
12 Society of Indiana County a tract of land situate in the
13 Borough of Indiana, County of Indiana, Pennsylvania;
14 authorizing and directing the Department of General Services,
15 with the approval of the Governor and Department of
16 Transportation, to sell and convey to the Borough of
17 Hollidaysburg certain land situate in the Borough of
18 Hollidaysburg, Blair County, Pennsylvania; authorizing the
19 Department of General Services, with the approval of the
20 Governor, to convey a tract of land in the Borough of
21 Selinsgrove, Snyder County, to the Eastern Snyder County
22 Regional Authority in exchange for another tract of land in
23 the Borough of Selinsgrove, Snyder County; and authorizing
24 and directing the Department of General Services, with the
25 approval of the Governor, to grant and convey to Snyder
26 County certain lands situate in Penn Township," further
27 providing for reversion of property.
28 The General Assembly of the Commonwealth of Pennsylvania
29 hereby enacts as follows:
30 Section 1. Section 1(d) of the act of June 25, 1999
1 (P.L.205, No.27), entitled, as amended, "An act authorizing the
2 Department of General Services, with the approval of the
3 Governor, to convey to East Allen Township, Northampton County,
4 certain land situate in East Allen Township, Northampton County,
5 and to convey to the trustees of the University of Pittsburgh
6 certain land situate in the City of Pittsburgh, Allegheny
7 County; authorizing and directing the State Armory Board of the
8 Department of Military and Veterans Affairs and the Department
9 of General Services, with the approval of the Governor, to
10 convey to the Historical and Genealogical Society of Indiana
11 County a tract of land situate in the Borough of Indiana, County
12 of Indiana, Pennsylvania; authorizing and directing the
13 Department of General Services, with the approval of the
14 Governor and Department of Transportation, to sell and convey to
15 the Borough of Hollidaysburg certain land situate in the Borough
16 of Hollidaysburg, Blair County, Pennsylvania; authorizing the
17 Department of General Services, with the approval of the
18 Governor, to convey a tract of land in the Borough of
19 Selinsgrove, Snyder County, to the Eastern Snyder County
20 Regional Authority in exchange for another tract of land in the
21 Borough of Selinsgrove, Snyder County; and authorizing and
22 directing the Department of General Services, with the approval
23 of the Governor, to grant and convey to Snyder County certain
24 lands situate in Penn Township," is amended to read:
25 Section 1. East Allen Township, Northampton County.

27 (d) Execution.--The deed of conveyance shall be approved as
28 provided by law and shall be executed by the Secretary of
29 General Services in the name of the Commonwealth of
30 Pennsylvania. Within [two] four years of this conveyance, East

1 Allen Township shall have the right of declaring in writing in
2 the form of notice sent to the Department of General Services,
3 Bureau of Real Estate, 505 North Office Building, Harrisburg, PA
4 17125, a reversion of the property to the Department of General
5 Services in the event that East Allen Township determines that
6 there are environmental problems not originating during East
7 Allen Township ownership for which it chooses not to undertake
8 abatement and/or remediation of those problems. In the event the
9 property reverts to Commonwealth of Pennsylvania within [two]
10 four years of this conveyance:
11 (1) East Allen Township shall assume financial
12 responsibility for any costs of restoring the Premises to the
13 condition it was in at the time of this transfer, if the
14 Premises are damaged as a result of East Allen Township's use
15 thereof, ordinary wear and tear excluded. Costs shall include,
16 but not be limited to, remediation of environmental
17 contamination, if any, resulting from East Allen Township's use
18 thereof; and
19 (2) the Department of General Services will not be
20 responsible for any fees that were nullified by the dedication
21 of land in lieu of payment as set forth in Section 1007 of East
22 Allen Township Subdivision and Land Development Ordinance; and
23 (3) at the discretion of the Secretary of General Services,
24 the property shall be offered for sale through auction, sealed
25 bid or request for proposal, under terms of the act of April 9,
26 1929 (P.L.177, No.175), known as The Administrative Code of
27 1929, and conditions in section 2405-A of the Administrative
28 Code of 1929 authorizing the conveyance of the herein noted
29 property to East Allen Township shall automatically cease and
30 become null and void.
