AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for mandatory 3 fingerprinting. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 9112(b) of Title 18 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 9112. Mandatory fingerprinting. 9 * * * 10 (b) Other cases.-- 11 (1) Where private complaints for a felony or misdemeanor 12 result in a conviction, the court of proper jurisdiction 13 shall order the defendant to submit for fingerprinting by the 14 municipal police of the jurisdiction in which the offense was 15 allegedly committed or in the absence of a police department, 16 the State Police. Fingerprints so obtained shall, within 48 17 hours, be forwarded to the central repository in a manner and 18 in such form as may be provided by the central repository.
1 (2) Where defendants named in police complaints are 2 proceeded against by summons, or for offenses under section 3 3929 (relating to retail theft), the court of proper 4 jurisdiction shall order the defendant to submit within five 5 days of such order for fingerprinting by the municipal police 6 of the jurisdiction in which the offense allegedly was 7 committed or, in the absence of a police department, the 8 State Police. A district justice when issuing a summons to a 9 defendant to appear in central court shall include an order 10 for fingerprinting of the defendant by the municipal police 11 of the jurisdiction in which the offense allegedly was 12 committed or by the State Police. Fingerprints so obtained 13 shall, within 48 hours, be forwarded to the central 14 repository in a manner and in such form as may be provided by 15 the central repository. 16 * * * 17 Section 2.
