                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the offense of driving while
     3     operating privileges are suspended or revoked.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1543(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1543.  Driving while operating privilege is suspended or
     9             revoked.
    10     (a)  Offense defined.--Except as provided in subsection (b),
    11  any person who drives a motor vehicle on any highway or
    12  trafficway of this Commonwealth after the commencement of a
    13  suspension, revocation or cancellation of the operating
    14  privilege and before the operating privilege has been restored
    15  is guilty of a summary offense and shall, upon conviction, be
    16  sentenced to pay a fine of $200. If the operating privilege that
    17  had been suspended, revoked or canceled was based on a junior


     1  driver's license or a learner's permit, then the defendant shall
     2  be required to appear in person before the issuing authority and
     3  shall be sentenced, in addition to any other penalties, to
     4  perform 100 hours of community service under the supervision of
     5  either the county in which the offense occurred or the county in
     6  which the defendant resides. The defendant's operating privilege
     7  shall not be restored until the county notifies the department
     8  that the 100 hours of community service have been completely
     9  performed.

    11     Section 2.  This act shall take effect in 60 days.
