AN ACT 1 Amending the act of February 22, 1855 (P.L.46, No.50), entitled 2 "An act to incorporate the Farmers' High School of 3 Pennsylvania," further providing for membership of the board 4 of trustees; providing for trustees for the Penn State Milton 5 S. Hershey Medical Center; further providing for 6 administration; and providing for funding. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 3 of the act of February 22, 1855 10 (P.L.46, No.50), entitled "An act to incorporate the Farmers' 11 High School of Pennsylvania," is amended to read: 12 Section 3. Membership of board of trustees; name and style 13 of board; power of board to take and dispose of property 14 The Governor, Secretary of the Commonwealth, one senator 15 appointed by the President Pro Tempore of the Senate, one 16 senator appointed by the Minority Leader of the Senate, one 17 representative appointed by the Speaker of the House of
1 Representatives, one representative appointed by the Minority 2 Leader of the House of Representatives, the President of the 3 Pennsylvania State Agricultural Society, and the principal of 4 the institution, shall each be ex officio a member of the board 5 of trustees, which said trustees, and their successors in 6 office, are hereby elected and declared to be a body politic and 7 corporate in law, with perpetual succession, by the name, style 8 and title of the Farmers' High School of Pennsylvania, by which 9 name and title the said trustees, and their successors, shall be 10 able and capable in law to take by gift, grant, sale or 11 conveyance, by bequest, devise or otherwise, any estate in any 12 lands, tenements and hereditaments, goods, chattels or effects, 13 and at pleasure to alien or otherwise dispose of the same to and 14 for the uses and purposes of the said institution: provided, 15 however, that the annual income of the said State, so held, 16 shall at no time exceed twenty-five thousand dollars; and the 17 said corporation shall by the same name have power to sue and be 18 sued, and generally to do and transact all and every business 19 touching or concerning the premises, or which shall be 20 necessarily incidental thereto, and to hold, enjoy and exercise 21 all such powers, authorities and jurisdiction as are customary 22 in the colleges within this Commonwealth. 23 Section 2. The act is amended by adding a section to read: 24 Section 3.1 Appointment of trustees of the board of the Penn 25 State Milton S. Hershey Medical Center 26 Four Commonwealth trustees, from among the members of the 27 Senate and the House of Representatives, shall be appointed to 28 the board of trustees of the Penn State Milton S. Hershey 29 Medical Center: one senator appointed by the President Pro 30 Tempore of the Senate, one senator appointed by the Minority 20010H1238B1435 - 2 -
1 Leader of the Senate, one representative appointed by the 2 Speaker of the House of Representatives and one representative 3 appointed by the Minority Leader of the House of 4 Representatives. The legislative appointees shall serve for a 5 term concurrent with their term in office. 6 Section 3. Section 6 of the act is amended to read: 7 Section 6. Powers and duties of trustees in general 8 On the second thursday of june after the passage of this act, 9 the board of trustees who are hereby appointed, shall meet at 10 Harrisburg, and proceed to the organization of the institution, 11 and selection of the most eligible site within the Commonwealth 12 of Pennsylvania for its location, where they shall purchase or 13 obtain by gift, grant or otherwise, a tract of land containing 14 at least two hundred acres, and not exceeding two thousand 15 acres, upon which they shall procure such improvements and 16 alterations to be made, as will make it an institution properly 17 adapted to the instruction of youth in the art of farming, 18 according to the meaning and design of this act; they shall 19 select and choose a principal for the said institution, who with 20 such scientific attainments and capacity, to teach as the board 21 shall deem necessary, shall be a good practical farmer., he with 22 such other persons as shall from time to time be employed as 23 teachers, shall compose the faculty, under whose control the 24 immediate management of the institution, and the instruction of 25 all the youth committed to its care, shall be subject however to 26 the revision and all orders of the board of trustees; there 27 shall be a quarterly meeting of the board of trustees at the 28 institution, and as much oftener as shall be necessary, and they 29 shall determine; the board shall have power to pass all such by- 30 laws, ordinances and rules as the good government of the 20010H1238B1435 - 3 -
1 institution shall require, and therein to prescribe what shall 2 be taught to and what labor performed by the pupils, and 3 generally to do and perform all such administrative acts as are 4 usually performed by and within the appropriate duty of a board 5 of trustees, and shall by a secretary of their appointment, keep 6 a minute of the proceedings and action of the board. 7 The president of the institution shall, by the first day of 8 october each year, make a report of all the activities of the 9 institution, instructional, administrative and financial, 10 including the names and addresses of each member of the board of 11 trustees, for the preceding scholastic and fiscal year, to the 12 board of trustees, who shall transmit the report to the Governor 13 and to the members of the General Assembly. 14 Section 4. The act is amended by adding a section to read: 15 Section 9.1. Funding restrictions 16 No money appropriated by the Commonwealth to the institution 17 may be used to deter union organizing or collective bargaining. 18 Section 5.
