                                     AN ACT

     1  Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An
     2     act relating to tax reform and State taxation by codifying
     3     and enumerating certain subjects of taxation and imposing
     4     taxes thereon; providing procedures for the payment,
     5     collection, administration and enforcement thereof; providing
     6     for tax credits in certain cases; conferring powers and
     7     imposing duties upon the Department of Revenue, certain
     8     employers, fiduciaries, individuals, persons, corporations
     9     and other entities; prescribing crimes, offenses and
    10     penalties," providing for a transfer of a portion of the
    11     personal income tax revenues to the counties for economic
    12     development purposes.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  The act of March 4, 1971 (P.L.6, No.2), known as
    16  the Tax Reform Code of 1971, is amended by adding a section to
    17  read:
    18     Section 302.3.  Distribution to Counties.--(a)  At the close
    19  of the fiscal year ending on June 30, 2001, and at the close of
    20  the next succeeding four fiscal years, the Commonwealth shall
    21  set aside for distribution to the counties of this Commonwealth
    22  as provided in subsection (b) revenues derived from the tax

     1  imposed under section 302, equal to the amount of revenue
     2  derived from a personal income tax rate of one-tenth of one per
     3  cent.
     4     (b)  The total amount of money set aside under subsection (a)
     5  shall be distributed by the State Treasurer to each county of
     6  this Commonwealth on a per capita basis based on the last
     7  Federal decennial census population figures for each county. The
     8  distribution shall be made on or before September 1 of each
     9  year.
    10     (c)  Moneys received by counties under this section shall
    11  only be used for economic development projects or job creation
    12  programs or as local matching funds to secure additional
    13  economic development projects and job creation programs.
    14     (d)  The provisions of this section shall expire January 1,
    15  2004.
    16     Section 2.  This act shall take effect immediately.
