        AS REPORTED FROM COMMITTEE ON TRANSPORTATION, HOUSE OF
           REPRESENTATIVES, AS AMENDED, APRIL 30, 2001

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for theft of
     3     services.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3926 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 3926.  Theft of services.
     9     * * *
    10     (f.1)  Theft of gasoline.--If a person is convicted of retail
    11  theft of gasoline under this section, the court shall, in
    12  addition to any other penalty authorized by law, order the
    13  operating privilege of the person suspended. A copy of the order
    14  shall be transmitted to the Department of Transportation. The
    15  duration of the suspension shall be as follows:
    16         (1)  For a first offense, a period of 60 days from the
    17     date of suspension.

     1         (2)  For a second offense, a period of 180 days from the
     2     date of suspension.
     3         (3)  For a third AND SUBSEQUENT offense, and any offense   <--
     4     thereafter, a period of one year from the date of suspension.
     5     Any multiple sentences imposed shall be served consecutively.  <--
     6     Reinstatement of operating privilege shall be governed by 75
     7     Pa.C.S. § 1545 (relating to restoration of operating
     8     privilege).

    10     Section 2.  This act shall take effect in 60 days.
