                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the erection of traffic-control
     3     signals on the basis of accident experience.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6122.1.  Erection of traffic-control signals on the basis of
     9             accident experience.
    10     (a)  General rule.--Notwithstanding any other provision of
    11  this title, the department shall erect a traffic-control signal
    12  at the intersection of a State-designated highway and a local
    13  road when the governing body of the municipality in which the
    14  intersection is located submits to the department evidence that
    15  five or more reported accidents, of types susceptible of
    16  correction by a traffic-control signal, have occurred at the

     1  intersection within a three-year period. In order to meet the
     2  requirements of this section, each accident must have involved
     3  personal injury or property damage to the apparent extent of
     4  $200 or more.
     5     (b)  Joint submission.--If an intersection is located in more
     6  than one municipality, the municipalities shall jointly submit
     7  the evidence required by subsection (a).
     8     (c)  Minimum vehicular volume.--When the requirements of
     9  subsection (a) are met, the department shall not consider
    10  whether the volume of intersecting traffic at the intersection
    11  would or would not warrant installment of a traffic-control
    12  device.
    13     Section 2.  This act shall take effect immediately.
