        SENATOR TILGHMAN, APPROPRIATIONS, IN SENATE, RE-REPORTED AS
           AMENDED, JUNE 5, 2001

                                     AN ACT

     1  Amending the act of November 22, 1978 (P.L.1166, No.274),
     2     entitled "An act establishing the Pennsylvania Commission on
     3     Crime and Delinquency, providing for its powers and duties
     4     establishing several advisory committees within the
     5     commission and providing for their powers and duties,"
     6     further providing for powers and duties of the commission.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 3 of the act of November 22, 1978
    10  (P.L.1166, No.274), referred to as the Pennsylvania Commission
    11  on Crime and Delinquency Law, is amended by adding a paragraph
    12  to read:
    13  Section 3.  Powers and duties of the commission.
    14     The commission shall have the power and its duty shall be:
    15         * * *
    16         (17)  To prepare and present upon the request of the

     1     chairman of the appropriate A committee TO WHICH THE BILL HAS  <--
     2     BEEN REFERRED a prison population impact analysis of any bill
     3     introduced in the General Assembly that would have an impact
     4     on prison or correction systems, as well as on State and
     5     local probation and parole populations and programs. The
     6     analysis shall be factual and, if possible, provide a
     7     reliable estimate of the prison population impact of the bill
     8     and shall be completed and presented to the committee
     9     requesting WHOSE CHAIRMAN REQUESTS the analysis and to the     <--
    10     Governor within 45 days of the initial request. The
    11     commission shall prepare the analysis in consultation with
    12     the Department of Corrections, the Pennsylvania Board of
    13     Probation and Parole and the Pennsylvania Commission on
    14     Sentencing, as appropriate. A request for a prison population
    15     impact analysis shall have no effect whatsoever upon the
    16     method, manner or ability of the General Assembly to consider
    17     any bill.
    18     Section 2.  This act shall take effect immediately.
