AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES, MARCH 13, 2001
AN ACT 1 Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An 2 act relating to tax reform and State taxation by codifying 3 and enumerating certain subjects of taxation and imposing 4 taxes thereon; providing procedures for the payment, 5 collection, administration and enforcement thereof; providing 6 for tax credits in certain cases; conferring powers and 7 imposing duties upon the Department of Revenue, certain 8 employers, fiduciaries, individuals, persons, corporations 9 and other entities; prescribing crimes, offenses and 10 penalties," making an editorial change relating to the name 11 of the Organ Donation Awareness Trust Fund; AND MAKING AN <-- 12 APPROPRIATION. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 315.4 of the act of March 4, 1971 (P.L.6, 16 No.2), known as the Tax Reform Code of 1971, added May 7, 1997 17 (P.L.85, No.7), is amended to read:
1 Section 315.4. Contributions for Organ and Tissue Donation 2 Awareness.--(a) The department shall provide a space on the 3 Pennsylvania individual income tax return form whereby an 4 individual may voluntarily designate a contribution of any 5 amount desired to the Governor Robert P. Casey Memorial Organ 6 and Tissue Donation Awareness Trust Fund established under 20 7 Pa.C.S. § 8622 (relating to the Governor Robert P. Casey 8 Memorial Organ and Tissue Donation Awareness Trust Fund). 9 (b) The amount so designated by an individual on the 10 Pennsylvania individual income tax return form shall be deducted 11 from the tax refund to which the individual is entitled and 12 shall not constitute a charge against the income tax revenues 13 due the Commonwealth. 14 (c) The department shall annually determine the total amount 15 designated pursuant to this section and shall report that amount 16 to the State Treasurer who shall transfer that amount to the 17 Governor Robert P. Casey Memorial Organ and Tissue Donation 18 Awareness Trust Fund. 19 (d) The department shall, in all taxable years following the 20 effective date of this section, provide on its forms or in its 21 instructions which accompany Pennsylvania individual income tax 22 return forms adequate information concerning the Governor Robert 23 P. Casey Memorial Organ and Tissue Donation Awareness Trust Fund 24 which shall include the listing of an address furnished to it by 25 the Organ Donation Advisory Committee to which contributions may 26 be sent by those taxpayers wishing to contribute to the fund but 27 who do not receive refunds. 28 (e) This section shall apply to taxable years beginning on 29 or after January 1, 1997. 30 SECTION 2. THE SUM OF $500,000 IS HEREBY APPROPRIATED FROM <-- 20010H0334B1071 - 2 -
1 THE GENERAL FUND AND SHALL BE TRANSFERRED TO THE GOVERNOR ROBERT
2 P. CASEY MEMORIAL ORGAN AND TISSUE DONATION AWARENESS TRUST FUND
3 TO REIMBURSE THE GOVERNOR ROBERT P. CASEY MEMORIAL ORGAN AND
4 TISSUE DONATION AWARENESS TRUST FUND FOR MONEYS TRANSFERRED TO
5 THE DEPARTMENT OF TRANSPORTATION FOR ADMINISTRATIVE COSTS TO
6 PROVIDE AN APPLICANT FOR A RENEWAL VEHICLE REGISTRATION WITH THE
7 OPPORTUNITY TO MAKE A CONTRIBUTION OF $1 TO THE GOVERNOR ROBERT
8 P. CASEY MEMORIAL ORGAN AND TISSUE DONATION AWARENESS TRUST
9 FUND.
10 Section 2 3. This act shall take effect immediately. <--
