                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for purchase of
     6     supplies.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 807.1 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended May 4, 1990 (P.L.164, No.38), is amended by adding a
    12  subsection to read:
    13     Section 807.1.  Purchase of Supplies.--* * *
    14     (b.1)  If, after competitive bids are received and opened or
    15  a minimum of three quotations are solicited, the district may
    16  purchase the exact items described therein from an alternate
    17  source if that source advertised, during the bidding or
    18  quotations period, the exact items for less than the lowest

     1  acceptable bid or quoted cost in a publication of unrestricted
     2  circulation, including, but not limited to, newspapers, flyers
     3  and sales brochures. The lowest acceptable bid or quotation and
     4  the advertised cost being considered by the district must
     5  address any delivery, set-up, training and warranty costs in an
     6  equal and comparable manner.
