SENATE BILL

                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," further providing
     6     for provisions applicable to all municipalities.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 561 of the act of June 1, 1945 (P.L.1242,
    10  No.428), known as the State Highway Law, added December 18, 1985
    11  (P.L.336, No.92), is amended by adding a subsection to read:
    12     Section 561.  Municipal Work and Reimbursement.--(a) A
    13  municipality and the department shall have the power to enter
    14  into a contract for the municipality to perform minor routine
    15  maintenance work on the roadway and shoulders of any State
    16  highway located within the municipal boundaries of the
    17  municipality.
    18     (b)  Each municipality which completes the work described in
    19  subsection (a) shall be relieved from any tort liability arising


     1  after completion of such work if the completed project conforms
     2  to the standards of the contract as agreed to by the department.
     3     (c)  Each municipality shall be entitled to receive payment
     4  or reimbursement from the department, in accordance with the
     5  contract, if the work is completed to the standards of the
     6  contract as agreed to by the department.
     7     (d)  Nothing contained in this subdivision shall impair,
     8  suspend, contract, enlarge, extend or affect in any manner the
     9  powers and duties of the Pennsylvania Public Utility Commission
    10  as contained in sections 2702, 2703 and 2704 of Title 66 of the
    11  Pennsylvania Consolidated Statutes (relating to public
    12  utilities).
    13     (e)  The department shall provide the same level of
    14  maintenance for the storm water minimization and containment
    15  infrastructure within borough limits as it does for such
    16  infrastructure in townships.
    17     Section 2.  This act shall take effect in 60 days.
