AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for
3 jury instructions.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 9711(c) of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended by adding a paragraph to read:
8 § 9711. Sentencing procedure for murder of the first degree.

10 (c) Instructions to jury.--

12 (3) The court shall instruct the jury that life
13 imprisonment means life in prison without consideration for
14 parole. The court shall further instruct the jury that the
15 Governor, upon the unanimous recommendation of the Board of
16 Pardons, has the power to grant a pardon or to commute a
17 sentence of death or life imprisonment.

1 Section 2. This act shall apply to trials commenced on or
2 after the effective date of this act.
3 Section 3. This act shall take effect in 60 days.
