                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for abandoned infants.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 18 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 511.  Abandoned infants.
     8     (a)  General rule.--Except as provided in subsection (b), it
     9  is justifiable for an individual who has physical custody of an
    10  infant less than 16 days of age to leave that infant with an
    11  emergency medical services provider.
    12     (b)  Exception.--Subsection (a) does not apply to an offense
    13  under any of the following:
    14         (1)  Chapter 25 (relating to criminal homicide).
    15         (2)  Chapter 29 (relating to kidnapping).
    16     (c)  Definitions.--As used in this section, the following
    17  words and phrases shall have the meanings given to them in this


     1  subsection:
     2     "Emergency medical services."  The services utilized in
     3  responding to the needs of an individual for immediate medical
     4  care in order to prevent loss of life or aggravation of
     5  physiological or psychological illness or injury.
     6     "Emergency medical services provider."  A person that
     7  regularly provides emergency medical services.
     8     Section 2.  This act shall take effect in 60 days.
