                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for an offense relating to
     3     contraband.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 914.  Contraband.
     9     (a)  Offenses.--A person commits a misdemeanor of the second
    10  degree if that person receives, retains, possesses or disposes
    11  of any movable property:
    12         (1)  Knowing that the movable property:
    13             (i)  is contraband; or
    14             (ii)  contains contraband.
    15         (2)  Believing that the movable property probably
    16         contains contraband.
    17     (b)  Exception.--This section shall not constitute a
    18  violation when the performer is a law enforcement officer acting

     1  in the scope of his assigned duties.
     2     (c)  Definition.--As used in this section, the term
     3  "contraband" means any property:
     4         (1)  That is unlawful to produce or possess.
     5         (2)  That the possession of that property is lawful, but
     6     that property was used or possessed in perpetration of an
     7     unlawful act.
     8     Section 2.  This act shall take effect in 60 days.
