SENATE BILL

                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," imposing limitations on
     4     expenditures for capitated behavioral health services in
     5     cities of the first class; and making a repeal.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, is amended by adding a section to
    10  read:
    11     Section 443.7.  Review of Certain Capitated Behavioral Health
    12  Service Payments.--(a)  Any expenditure of Federal or State
    13  funds by a capitated behavioral health services of a city of the
    14  first class shall be reviewed by the board established under
    15  subsection (b).
    16     (b)  The board shall consist of one member appointed by the
    17  President pro tempore of the Senate, one member appointed by the
    18  Speaker of the House of Representatives, the mayor, the
    19  president of city council and one member appointed by the

     1  Governor.
     2     (c)  Any capitated behavioral health services reinvestment
     3  plan of a city of the first class regarding the expenditure of
     4  funds must be approved by a majority vote of a five member board
     5  prior to submission to the department.
     6     (d)  The city of the first class shall provide quarterly
     7  financial reports to the board, to include a description of all
     8  contracts, contractors, service agreements and service providers
     9  and expenditures relating to capitated behavioral health
    10  services.
    11     Section 2.  The fifth through seventh sentences of the
    12  appropriation for medical assistance payments - capitation plans
    13  in section 219 of the act of May 5, 1999 (P.L.   , No.1A), known
    14  as the General Appropriation Act of 1999, are repealed.
    15     Section 3.  This act shall take effect July 1, 1999.
