        INTRODUCED BY MURPHY, RHOADES, CONTI, DENT, JUBELIRER, TILGHMAN,
           ROBBINS, SALVATORE, BRIGHTBILL, HOLL, TOMLINSON, CORMAN,
           WAGNER, STOUT, COSTA, GREENLEAF, HELFRICK, STAPLETON,
           GERLACH, MADIGAN, BELL, SCHWARTZ, BODACK, O'PAKE AND MELLOW,
           MAY 3, 1999

        AS AMENDED ON THIRD CONSIDERATION, JUNE 9, 1999

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," requiring reports of incidents of
     6     school violence to PARENTS OR GUARDIANS AND local law          <--
     7     enforcement agencies.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 1318.1.  Mandatory Reporting of Acts of Violence to
    14  PARENT OR GUARDIAN AND Local Law Enforcement.--Every principal    <--
    15  in charge of a public school shall immediately report to the
    16  PARENT OR GUARDIAN AND TO THE local law enforcement agency with   <--
    17  jurisdiction over that public school the commission of an act of
    18  violence by a pupil. The procedures for reporting acts of
    19  violence shall be in compliance with the procedures set forth in

     1  the school entity's memorandum of understanding with the local
     2  law enforcement agency as required in section 1303-A(c) of this
     3  act. For the purposes of this section, acts of violence shall
     4  include:
     5     (1)  Possession of a weapon OTHER THAN A FIREARM on school     <--
     6  property.
     7     (2)  Possession of an offensive weapon.
     8     (3)  Possession of an instrument of crime.
     9     (4)  Possession of a firearm, SHOTGUN OR RIFLE on school       <--
    10  property.
    11     (5)  Aggravated assault.
    12     (6)  Terroristic threats.
    13     (7)  Harassment.
    14     (8)  Stalking.
    15     (9)  Criminal homicide.
    16     (10)  Rape.
    17     (11)  Arson.
    18     (12)  Kidnapping.
    19     (13)  Robbery.
    20     Section 2.  This act shall take effect immediately.
