                                     AN ACT

     1  Amending the act of November 22, 1978 (P.L.1166, No.274),
     2     entitled "An act establishing the Pennsylvania Commission on
     3     Crime and Delinquency, providing for its powers and duties
     4     establishing several advisory committees within the
     5     commission and providing for their powers and duties,"
     6     further providing for duties of the Pennsylvania Commission
     7     on Crime and Delinquency relative to criminal statistics; and
     8     further providing for the duties of public agencies and
     9     officers in reporting criminal statistics.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 4(7) of the act of November 22, 1978
    13  (P.L.1166, No.274), referred to as the Pennsylvania Commission
    14  on Crime and Delinquency Law, amended April 30, 1986 (P.L.125,
    15  No.38), is amended to read:
    16  Section 4.  Duties of the commission relative to criminal
    17                 statistics.
    18     The commission shall have the power and its duty shall be:
    19         * * *
    20         (7)  To present to the Governor and the members of the
    21     General Assembly each year a report containing the criminal

     1     statistics of the preceding calendar year, including
     2     information on charges brought pursuant to 18 Pa.C.S. § 2710
     3     (relating to ethnic intimidation), and to present at such
     4     other times as the commission deems necessary reports on the
     5     special aspects of criminal and juvenile statistics. This
     6     report need not duplicate information contained in reports of
     7     other administrative agencies unless a specific purpose
     8     exists.

    10     Section 2.  Section 5 of the act is amended to read:
    11  Section 5.  Duties of public agencies and officers in reporting
    12                 criminal statistics.
    13     It shall be the duty of every constable, chief of police,
    14  county police force, sheriff, coroner, district attorney, chief
    15  probation officer and of the Bureau of Correction in the
    16  Department of Justice, the Pennsylvania Board of Probation and
    17  Parole, the Pennsylvania State Police, the State Court
    18  Administrator, the Juvenile Court Judges' Commission, the
    19  Department of Public Welfare, State Fire Marshal, Pennsylvania
    20  Liquor Control Board, the Philadelphia Municipal and Traffic
    21  Courts, justices of the peace, county prison wardens, and every
    22  other person or agency dealing with crimes or criminals or with
    23  delinquency or delinquents, when requested by the commission:
    24         (1)  To install and maintain records and recording
    25     systems needed for the correct reporting of statistical data
    26     required by the commission.
    27         (2)  To report statistical data to the commission at such
    28     times and in such manner as the commission prescribes.
    29         (3)  To give to the staff of the commission access to
    30     statistical data for the purpose of carrying out the duties

     1     of the commission relative to criminal statistics.
     2         (4)  To report to the commission regarding charges
     3     brought pursuant to 18 Pa.C.S. § 2710 (relating to ethnic
     4     intimidation).
     5     Section 3.  This act shall take effect immediately.
