                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for certain
     4     benefits for persons who are permanently disabled.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 443.6 of the act of June 13, 1967
     8  (P.L.31, No.21), known as the Public Welfare Code, is amended by
     9  adding a subsection to read:
    10     Section 443.6.  Reimbursement for Certain Medical Assistance
    11  Items and Services.--* * *
    12     (d.1)  A person eighteen years of age or over who is unable
    13  to engage in any substantial gainful activity by reason of any
    14  medically determinable physical or mental impairment which can
    15  be expected to continue indefinitely shall be eligible to
    16  receive prescription assistance in the same amount as provided
    17  for in chapter 5 of the act of August 26, 1971 (P.L.351, No.91),
    18  known as the "State Lottery Law," for life-sustaining


     1  maintenance drugs as determined by the department. Each year the
     2  person with a permanent disability shall submit an affidavit of
     3  disability or a copy of a document issued by the Social Security
     4  Administration, which affidavit or document shows that the
     5  person was so disabled during the previous year.

     7     Section 2.  This act shall take effect in 90 days.
