                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, relating to the reduction of certain speed limits.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 3363 of Title 75 of the Pennsylvania
     6  Consolidated Statutes, amended December 21, 1998 (P.L.    ,
     7  No.151), is amended to read:
     8  § 3363.  Alteration of maximum limits.
     9     (a)  General rule.--On highways under their respective
    10  jurisdictions, local authorities, subject to section 6109(e)
    11  (relating to specific powers of department and local
    12  authorities), or the department, upon the basis of an
    13  engineering and traffic investigation, may determine that the
    14  maximum speed permitted under this subchapter is greater or less
    15  than is reasonable and safe under the conditions found to exist
    16  upon any such highway or part thereof and establish a reasonable
    17  and safe maximum limit. The maximum speed limit may be made


     1  effective at all times or at times indicated and may vary for
     2  different weather conditions and other factors bearing on safe
     3  speeds. No maximum speed greater than 55 miles per hour shall be
     4  established under this section except on highways listed in
     5  section 3362(a)(1.1) (relating to maximum speed limits), where
     6  the maximum speed for all vehicles shall not be greater than 65
     7  miles per hour.
     8     (b)  Local authority requests for reductions.--The department
     9  shall reduce the speed limit on State highways located in
    10  municipalities, other than limited access highways, when a
    11  reduction is requested by the local authorities by means of an
    12  ordinance or resolution duly adopted by the governing body of
    13  the local authority. The request shall be accompanied by an
    14  engineering study that finds the existing speed limit to be
    15  excessive.
    16     Section 2.  This act shall take effect in 90 days.
