     1  To provide from the General Fund for the expenses of the
     2     Executive, Legislative and Judicial Departments of the
     3     Commonwealth, the public debt and for the public schools for
     4     the fiscal year July 1, 2000, to June 30, 2001, for certain
     5     institutions and organizations, and for the payment of bills
     6     incurred and remaining unpaid at the close of the fiscal year
     7     ending June 30, 2000; and to provide for the additional
     8     appropriation of Federal and State funds for the Executive
     9     Department of the Commonwealth for the fiscal year July 1,
    10     1999, to June 30, 2000, and for the payment of bills incurred
    11     and remaining unpaid at the close of the fiscal year ending
    12     June 30, 1999.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14                               PART I
    15                         GENERAL PROVISIONS
    16     Section 101.  Short title.--This act shall be known and may
    17  be cited as the General Appropriation Act of 2000.
    18     Section 102.  Definitions.--The following words and phrases
    19  when used in this act shall have the meanings given to them in
    20  this section unless the context clearly indicates otherwise:
    21     "Employees."  Includes all directors, superintendents, bureau
    22  or division chiefs, assistant directors, assistant
    23  superintendents, assistant chiefs, experts, scientists,
    24  engineers, surveyors, draftsmen, accountants, secretaries,
    25  auditors, inspectors, examiners, analysts, statisticians,
    26  marshals, clerks, stenographers, bookkeepers, messengers and
    27  other assistants in any department, board or commission.
    28     "Expenses" and "maintenance."  Includes all printing, binding
    29  and stationery, food and forage, materials and supplies,
    30  traveling expenses, training, motor vehicle supplies and

     1  repairs, freight, express and cartage, postage, telephones and
     2  telegraph rentals and toll charges, newspaper advertising and
     3  notices, public advertising by or through any medium, fuel,
     4  light, heat, power and water, minor construction and renovation,
     5  repairs or reconstruction of equipment, buildings and
     6  facilities, rent of real estate and equipment, premiums on
     7  workers' compensation, insurance premiums on policies of
     8  liability insurance, insurance premiums on medical payment
     9  insurance and surety bonds for volunteer workers, premiums on
    10  employee group life insurance and employee and retired employee
    11  group hospital and medical insurance, payment of Commonwealth
    12  share of Social Security taxes and unemployment compensation
    13  costs for State employees, the purchase of replacement or
    14  additional equipment and machinery and all other incidental
    15  costs and expenses, including payment to the Department of
    16  General Services of mileage and other charges for the use of
    17  automobiles and rental payments for permanently assigned
    18  automobiles and of expenses or costs of services incurred
    19  through the Purchasing Fund. The term "expenses" also shall
    20  include the medical costs for the treatment of inmates of State
    21  institutions when the inmate must be transferred to an outside
    22  hospital: Provided, That in no case shall the State institution
    23  pay more for patient care than that provided under the State
    24  medical assistance program.
    25     Section 103.  Abbreviations.--The following abbreviations
    26  when used in this act shall have the meanings given to them in
    27  this section unless the context clearly indicates otherwise:
    28     "ARC."  Appalachian Regional Commission.
    29     "BG."  Block grant.

    27     Section 104.  State appropriations.--The following sums set
    28  forth in this act, or as much thereof as may be necessary, are
    29  hereby specifically appropriated from the General Fund to the
    30  several hereinafter named agencies of the Executive, Legislative

     1  and Judicial Departments of the Commonwealth for the payment of
     2  salaries, wages or other compensation and travel expenses of the
     3  duly elected or appointed officers and employees of the
     4  Commonwealth, for the payment of fees for contractual services
     5  rendered, for the purchase or rental of goods and services,
     6  printing, public advertising by or through any medium,
     7  equipment, land and buildings and for payment of any other
     8  expenses, as provided by law or by this act, necessary for the
     9  proper conduct of the duties, functions and activities and for
    10  the purposes hereinafter set forth for the fiscal year beginning
    11  July 1, 2000, and for the payment of bills incurred and
    12  remaining unpaid at the close of the fiscal year ending June 30,
    13  2000.
    14     Section 105.  Federal augmentation appropriations.--The
    15  following Federal augmentation appropriations set forth in this
    16  act, or as much thereof as may be necessary, are hereby
    17  specifically appropriated from the Federal augmentation funds to
    18  the several hereinafter named agencies of the Executive
    19  Department of the Commonwealth for the payment of the expenses
    20  of implementing and carrying out the programs stated herein for
    21  the fiscal year beginning July 1, 2000, and for the payment of
    22  bills incurred and remaining unpaid at the close of the fiscal
    23  year ending June 30, 2000. Unless otherwise stated, the
    24  appropriations include any carryovers from the prior fiscal
    25  year.
    26     Section 106.  Block grants.--(a)  Appropriation.--The
    27  following sums set forth in this act, or as much thereof as may
    28  be necessary, are hereby specifically appropriated from the
    29  block grant (BG) funds to the several hereinafter named agencies
    30  of the Executive Department of the Commonwealth for the

     1  purposes, and under the restrictions, for which the funds are
     2  provided for the fiscal year beginning July 1, 2000.
     3     (b)  Small Communities Development Block Grant.--The Small
     4  Communities Development Block Grant (SCDBG) is to assist small
     5  cities and communities that have a high concentration of
     6  impoverished citizens and substandard housing to expand their
     7  low-income and moderate-income housing opportunities and to meet
     8  community development needs.
     9     (c)  Community Services Block Grant.--The Community Services
    10  Block Grant (CSBG) is to provide a range of services and
    11  activities having a measurable and potentially major impact on
    12  the causes of poverty in the community or those areas of the
    13  community where poverty is a particularly acute problem. In
    14  addition, new focus may be placed on the unemployed, both old
    15  and new. Local agencies may lower their eligibility requirements
    16  for recipients to three months to allow greater flexibility to
    17  assure proper consideration of each recipient.
    18     (d)  Preventive Health and Health Services Block Grant.--The
    19  Preventive Health and Health Services Block Grant (PHHSBG) is
    20  for the provision of preventive health and other health services
    21  related to emergency medical systems, health initiative grants,
    22  comprehensive public health, hypertension, fluoridation, health
    23  education, risk reduction, home health, rape crisis and domestic
    24  violence services.
    25     (e)  Maternal and Child Health Services Block Grant.--The
    26  Maternal and Child Health Services Block Grant (MCHSBG) is to
    27  enable states to maintain and strengthen their leadership in
    28  planning, promoting, coordinating and evaluating health care for
    29  pregnant women, mothers, infants and children, and children with
    30  special health care needs, and in providing health services for

     1  mothers and children who do not have access to adequate health
     2  care.
     3     (f)  Low-Income Home Energy Assistance Block Grant.--The Low-
     4  Income Home Energy Assistance Block Grant (LIHEABG) is to help
     5  lessen the impact of the high cost of energy on low-income
     6  families and individuals, including energy efficiency grants for
     7  low-income dwellings. No less than 15% of the LIHEABG funds
     8  received shall be used for weatherization. LIHEABG funds
     9  received pursuant to a Presidential release of weather-related
    10  contingency funds shall be exempt from the 15% requirement if
    11  the weather emergency has an impact in Pennsylvania. Unexpended
    12  weatherization funds which would result in LIHEABG funds being
    13  returned to the Federal Department of Health and Human Services
    14  may be spent for assistance grants at the discretion of the
    15  Secretary of the Budget. The Secretary of the Budget shall
    16  notify the chairman and the minority chairman of the
    17  Appropriations Committee of the Senate and the chairman and the
    18  minority chairman of the Appropriations Committee of the House
    19  of Representatives of the intent to reallocate any such funds
    20  ten days prior to any reallocation.
    21     (g)  Social Services Block Grant.--The Social Services Block
    22  Grant (SSBG) is for the provision of social services to eligible
    23  persons.
    24     (h)  Mental Health Services Block Grant.--The Mental Health
    25  Services Block Grant (MHSBG) provides funds for the provision of
    26  services to adults with serious mental illness or children with
    27  serious emotional disturbance.
    28     (i)  Substance Abuse Block Grant.--The Substance Abuse Block
    29  Grant (SABG) provides funds to establish and maintain programs
    30  to combat alcohol and drug abuse.

     1     (j)  Child Care and Development Fund Block Grant.--The Child
     2  Care and Development Fund Block Grant (CCDFBG) is for the
     3  provision of direct child care or to increase the availability
     4  of child care for low-income families.
     5     (k)  Temporary Assistance for Needy Families Block Grant.--
     6  The Temporary Assistance for Needy Families Block Grant (TANFBG)
     7  provides funds for the provision of cash grants, child care,
     8  training and support services, child welfare and administration
     9  for eligible families and individuals.

     8  updated on a quarterly basis, on the
     9  unduplicated caseloads, unduplicated
    10  services and number of caseworkers by
    11  county program. This date is to be
    12  provided in a form acceptable to the
    13  Department of Public Welfare. A copy
    14  of the data shall be sent to the
    15  chairman and the minority chairman of
    16  the Appropriations Committee of the
    17  Senate and to the chairman and the
    18  minority chairman of the
    19  Appropriations Committee of the House
    20  of Representatives. The department may
    21  use up to $5,703,000 of this
    22  appropriation to fund contracts for
    23  adoption services. Reimbursement for
    24  children and youth services made
    25  pursuant to section 704.1 of the act
    26  of June 13, 1967 (P.L.31, No.21),
    27  known as the Public Welfare Code,
    28  shall not exceed the amount of State
    29  funds appropriated. This appropriation
    30  includes sufficient funds for up to a

    23     Section 491.  Prior laws unaffected.--This act is not
    24  intended to be inconsistent with or to repeal any provision of
    25  any act enacted at this or any prior session of the General
    26  Assembly regulating the purchase of supplies, the ordering of
    27  printing and binding, the purchase, maintenance and use of
    28  automobiles, the method of making payments from the State
    29  Treasury for any purpose or the functioning of any
    30  administrative department, board or commission.

     1     Section 492.  Compliance with other law before funds
     2  available.--No appropriation made by this part to any
     3  department, board, commission or agency of the Executive
     4  Department shall be available unless and until the department,
     5  board, commission or agency has complied with sections 615 and
     6  616 of the act of April 9, 1929 (P.L.177, No.175), known as The
     7  Administrative Code of 1929.
     8     Section 493.  Contracts prerequisite to encumbering or
     9  committing funds.--Funds for the purchase of supplies, materials
    10  and equipment shall not be deemed to be committed or encumbered
    11  until contracts covering the purchase have been entered into
    12  with the vendors.
    13     Section 494.  Minority business set-asides.--(a)  Each
    14  department or other instrumentality of the Commonwealth listed
    15  in Subpart B authorized to contract for buildings, highways,
    16  commodities, equipment, supplies or services shall report to the
    17  General Assembly all information pertinent to anticipated
    18  procurement needs at the beginning of each fiscal year and each
    19  fiscal quarter thereafter.
    20     (b)  As used in this section, the term "minority business"
    21  means a minority business enterprise as defined in the act of
    22  July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
    23  Minority Business Development Authority Act.
    24     Section 495.  Appropriation of funds from miscellaneous
    25  sources.--(a)  In addition to the amounts appropriated by this
    26  part, moneys received in payment for food and household supplies
    27  furnished to employees and other persons, except inmates, by an
    28  institution, and moneys received from the proceeds from the sale
    29  of any products of the soil, meats, livestock, timber or other
    30  materials sold by the department shall be paid into the General

     1  Fund and are hereby appropriated out of the General Fund to the
     2  several respective institutions for the operation and
     3  maintenance of the institutions.
     4     (b)  In addition to the amounts appropriated by this part,
     5  all moneys received from any other source, except the Federal
     6  Government, as contributions for the programs provided herein or
     7  as payment for services or materials furnished by one
     8  institution to another, except those collections designated as
     9  revenues, shall be paid into the General Fund and are hereby
    10  appropriated out of the General Fund for the purposes of the
    11  respective appropriations.
    12     (c)  In addition to any funds specifically appropriated by
    13  this part, all moneys received by a department or agency of the
    14  Commonwealth from any other sources, except the Federal
    15  Government, as contributions or supplements to the department or
    16  agency for a program or administration of an act included in
    17  this part shall be paid into the General Fund and credited to
    18  the appropriation for that program or administration of the act.
    19     Section 496.  Lapsing of unused funds.--(a)  Except as
    20  otherwise provided in subsection (b) and by law, that part of
    21  all appropriations in Part IV unexpended, uncommitted or
    22  unencumbered as of June 30, 2000, shall automatically lapse as
    23  of that date.
    24     (b)  The appropriation to the Department of Community and
    25  Economic Development in section 413 for local government costs
    26  associated with the homeowners' tax rebate program shall not
    27  lapse until June 30, 2001.
    28     Section 497.  Construction with prior appropriation acts.--
    29  Any appropriation in Subpart B of this part which is the same or
    30  similar to any appropriation in the act of May 5, 1999 (P.L.   ,

     1  No.1A), known as the General Appropriation Act of 1999, shall
     2  replace that appropriation. Any distribution of funds under
     3  section 239 of the act of April 22, 1998 (P.L.1341, No.6A),
     4  known as the General Appropriation Act of 1998, are included in
     5  the amounts in this part.
     6     Section 498.  Deduction of expended appropriations under
     7  prior law.--Any money which has been appropriated and expended
     8  under the act of May 5, 1999 (P.L.   , No.1A), known as the
     9  General Appropriation Act of 1999, shall be deducted from the
    10  corresponding appropriation in this part.
    11                               PART V
    12                SPECIAL PROVISIONS FOR FEDERAL FUNDS
    13                           FOR 2000-2001
    14     Section 501.  General Fund repository for Federal funds.--All
    15  moneys received from the Federal Government as contributions or
    16  supplements to the departments or agencies of the Commonwealth
    17  or the programs herein provided shall be paid into the General
    18  Fund.
    19     Section 502.  Limitation on encumbering or spending Federal
    20  funds.--Federal funds shall be encumbered or spent only to the
    21  extent that such funds are estimated as being available during
    22  the fiscal year of the Commonwealth.
    23     Section 503.  Appropriation of prior unspent Federal funds.--
    24  Any Federal money which has been previously appropriated by the
    25  General Assembly and authorized or allocated by the Federal
    26  Government but remains unspent from prior fiscal years and will
    27  not be renewed for fiscal year 2000-2001 is hereby appropriated.
    28     Section 504.  Subgrants between Federal fund
    29  appropriations.--With the exception of Federal money received
    30  under SSBG, subgrants may be made between appropriations without

     1  further approval of the General Assembly. The Secretary of the
     2  Budget shall submit a list of subgrants to the chairman and
     3  minority chairman of the Appropriations Committee of the Senate
     4  and the chairman and minority chairman of the Appropriations
     5  Committee of the House of Representatives quarterly. No subgrant
     6  to a State agency, however, may be made from a restricted
     7  receipt account without a specific appropriation by the General
     8  Assembly.
     9     Section 505.  Utilization of emergency Federal funds.--(a)
    10  Federal funds available for costs and damages resulting from
    11  natural disasters or civil disobedience may be added to an
    12  appropriation contained in this act or to funds appropriated or
    13  may be used for the purposes prescribed by the Federal
    14  Government.
    15     (b)  In addition to the moneys appropriated by this act, all
    16  moneys received from the Federal Government for the purpose of
    17  disaster assistance or relief shall be paid into the General
    18  Fund and are hereby appropriated out of the General Fund to the
    19  departments, boards, commissions or agencies designated by the
    20  Governor.
    21     (c)  In the event of any emergency situation in which the
    22  General Assembly cannot act in sufficient time, the Governor is
    23  authorized through executive authorization to provide up to
    24  $10,000,000 in Federal funds to alleviate the emergency
    25  situation. For the purposes of this section, "emergency" is
    26  defined as any situation in which there is a chance of or which
    27  may result in substantial human suffering.
    28                              PART VI
    29               MISCELLANEOUS PROVISIONS FOR 2000-2001
    30     Section 601.  Prior laws unaffected.--Except as provided in

     1  section 253, this act is not intended to be inconsistent with or
     2  to repeal any provision of any act enacted at this or any prior
     3  session of the General Assembly regulating the purchase of
     4  supplies, the ordering of printing and binding, the purchase,
     5  maintenance and use of automobiles, the method of making
     6  payments from the State Treasury for any purpose or the
     7  functioning of any administrative department, board or
     8  commission.
     9     Section 602.  Compliance with other law before funds
    10  available.--No appropriation made by this act to any department,
    11  board, commission or agency of the Executive Department shall be
    12  available unless and until the department, board, commission or
    13  agency has complied with sections 615 and 616 of the act of
    14  April 9, 1929 (P.L.177, No.175), known as The Administrative
    15  Code of 1929.
    16     Section 603.  Contracts prerequisite to encumbering or
    17  committing funds.--Funds available to agencies, boards,
    18  departments, commissions, or other governmental entities under
    19  this act for the procurement of supplies, services or
    20  construction shall not be available for payment of, or to be
    21  committed to or encumbered for payment of, any such procurement
    22  unless and until the agency, board, department or other
    23  governmental entity has complied with all of the requirements
    24  applicable to the procurement that are set out in 62 Pa.C.S.
    25  (relating to procurement) and in the policies, procedures and
    26  regulations instituted in accordance with that code.
    27     Section 604.  Minority business set-asides.--(a)  Each
    28  department or other instrumentality of the Commonwealth listed
    29  in Subpart A of Part II authorized to contract for buildings,

     3     Section 606.  Lapsing of unused funds.--(a)  Except as
     4  otherwise provided by law or by this section, that part of all
     5  appropriations in Parts II and III unexpended, uncommitted or
     6  unencumbered as of June 30, 2001, shall automatically lapse as
     7  of that date.
     8     (b)  The appropriations in sections 251, 253, 254, 255, 256,
     9  257, 258, 259, 260, 262 and 263 shall be continuing
    10  appropriations.
    11     Section 607.  Appellate courts appropriation contingency.--
    12  The funds appropriated in Part II to the Supreme, Superior and
    13  Commonwealth Courts for justice and judge expenses are
    14  contingent upon a vouchered expense account plan being continued
    15  by the Supreme Court.
    16     Section 608.  Transfer of excess funds.--The Governor may
    17  transfer any excess money in those funds receiving proceeds of
    18  Commonwealth of Pennsylvania general obligation bonds in excess
    19  of the amount necessary for the purposes for which the bonds
    20  were issued to the appropriate sinking fund for payment of debt
    21  service due on outstanding bonds. If such excess funds, together
    22  with any available balance, exceed the amount of debt service
    23  remaining to be paid, the funds shall be transferred to the
    24  General Fund or to the appropriate special fund responsible for
    25  such debt service.
    26     Section 609.  Transfer of funds by the Supreme Court.--(a)
    27  The Supreme Court may transfer any excess funds appropriated in
    28  sections 281, 286, 287, 288 and 291 to the Judicial Department
    29  in Part II to the Judicial Computer Augmentation Account during
    30  the month of June 2001. No transfer may create or increase a

     1  deficiency in the appropriation from which the transfer is made.
     2  Whenever the Supreme Court makes a transfer under this
     3  subsection, the Supreme Court shall give written notification to
     4  the Secretary of the Budget and chairman and minority chairman
     5  of the Senate Committee on Appropriations and the chairman and
     6  the minority chairman of the House of Representatives Committee
     7  on Appropriations ten days prior to any transfer which shall
     8  also include certification that such transfer will not result in
     9  a deficit in any appropriation.
    10     (b)  The Supreme Court may transfer funds appropriated in
    11  section 281 between the line items in that section provided that
    12  no transfer may create or increase a deficiency in the
    13  appropriation from which the transfer is made. Whenever the
    14  Supreme Court makes a transfer under this subsection, the
    15  Supreme Court shall give written notification to the Secretary
    16  of the Budget and the chairman and minority chairman of the
    17  Senate Committee on Appropriations and the chairman and the
    18  minority chairman of the House of Representatives Committee on
    19  Appropriations ten days prior to any transfer which shall also
    20  include certification that such transfer will not result in a
    21  deficit in any appropriation.
    22                              PART VII
    23                           EFFECTIVE DATE
    24     Section 701.  Effective date.--This act shall take effect as
    25  follows:
    26         (1)  Part IV and this section shall take effect
    27     immediately.
    28         (2)  The remainder of this act shall take effect July 1,
    29     2000, or immediately, whichever is later.
