                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for employer responsibilities
     3     relating to commercial drivers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1605(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1605.  Employer responsibilities.
     9     (a)  Requirements.--
    10         (1)  Each employer shall require the applicant to provide
    11     the information specified in section 1604(c) (relating to
    12     notification requirements for drivers).
    13         (2)  Each employer shall inform the applicant that the
    14     information he provides in accordance with section 1604(c)
    15     may be used and the applicant's previous employers may be
    16     contacted for the purpose of investigating the applicant's
    17     work history.


     1         (3)  Each employer shall store and maintain the
     2     information provided in accordance with section 1604(c) or
     3     obtained by the employer as a result of its investigation of
     4     the applicant's work history in a confidential manner and may
     5     not disclose or otherwise release any of that information to
     6     a person other than the applicant, except upon the written
     7     consent of the applicant or upon an order of court.

     9     Section 2. This act shall take effect in 60 days.
