                                     AN ACT

     1  Authorizing a grant program for type 1 diabetics; providing for
     2     powers and duties of the Department of Health; and making an
     3     appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Juvenile
     8  Diabetics Grant Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Health of the Commonwealth.
    14     "Master Settlement Agreement."  The settlement agreement and


     1  related documents entered into on November 23, 1998, by the
     2  Commonwealth and leading United States tobacco product
     3  manufacturers and approved by the court in Commonwealth v.
     4  Philip Morris, April Term 1997, No.2443 (C.P. Philadelphia
     5  County), on January 13, 1999.
     6     "Type 1 diabetic."  A person from birth to 18 years of age
     7  who has been diagnosed with type 1 diabetes.
     8  Section 3.  Payment for type 1 diabetics.
     9     (a)  Grants authorized.--The department shall utilize a
    10  portion of the tobacco Master Settlement Agreement funds to
    11  provide grants to type 1 diabetics as provided in this section.
    12     (b)  Eligibility.--A type 1 diabetic shall be eligible for a
    13  grant for diabetic treatments and equipment if the diabetic:
    14         (1)  does not have health insurance; or
    15         (2)  is not covered by a health insurance plan, including
    16     a government-sponsored plan, that provides coverage for the
    17     treatment or equipment, including, but not limited to,
    18     insulin pumps.
    19     (c)  Amount of grants.--The amount of each grant awarded
    20  under this grant shall be equal to the cost of diabetic
    21  treatment and equipment, including, but not limited to, insulin
    22  pumps, not covered by the grant recipient's health insurance
    23  plan, provided that no grant shall be in excess of $2,500.
    24     (d)  Regulations.--The department shall administer this
    25  section and shall promulgate rules, regulations and standards
    26  for its proper enforcement and administration.
    27  Section 4.  Appropriation.
    28     The sum of $3,000,000 is hereby appropriated to the
    29  Department of Health from the moneys received by the
    30  Commonwealth from the Master Settlement Agreement for the fiscal

     1  year July 1, 2000, to June 30, 2001, for the purpose of awarding
     2  grants to type 1 diabetics in accordance with this act. This
     3  appropriation shall be a continuing appropriation and shall not
     4  lapse at the end of the fiscal year.
     5  Section 5.  Effective date.
     6     This act shall take effect June 1, 2000, or immediately,
     7  whichever is later.
