                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for retaliation
     3     against witness or victim.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4953 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4953.  Retaliation against a party, witness or victim.
     9     (a)  Offense defined.--A person commits an offense if he
    10  harms another by any unlawful act or by engaging in a course of
    11  conduct or repeatedly committing acts which alarm or seriously
    12  annoy the victim in retaliation for anything lawfully done in
    13  the capacity of witness or victim or a party in a civil matter.
    14     (b)  Grading.--The offense is a felony of the third degree if
    15  the retaliation is accomplished by any of the means specified in
    16  section 4952(b)(1) through (5) (relating to intimidation of
    17  witnesses or victims). Otherwise the offense is a misdemeanor of

     1  the second degree.
     2     Section 2.  This act shall take effect immediately.
