                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for definitions and
     3     for the acquisition of certificates of public convenience.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 102 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding definitions to read:
     8  § 102.  Definitions.
     9     Subject to additional definitions contained in subsequent
    10  provisions of this part which are applicable to specific
    11  provisions of this part, the following words and phrases when
    12  used in this part shall have, unless the context clearly
    13  indicates otherwise, the meanings given to them in this section:
    14     * * *
    15     "Exclusive service."  Transportation on a given trip when the
    16  first or principal person or party or group hiring the vehicle
    17  has the exclusive right to determine where, when or if another


     1  passenger shall be carried on that trip.
     2     * * *
     3     "Limousine service."  The transport of persons in luxury type
     4  vehicles with seating capacities of ten passengers or less,
     5  excluding the driver, on an exclusive basis between points as
     6  authorized by the certificate of public convenience, provided
     7  that the order for service is received in advance of the actual
     8  rendering of service and whose payment for services rendered is
     9  made by a single person or organization.
    10     "Luxury-type vehicle."  Vehicles minimally equipped with air
    11  conditioning, AM/FM stereo radio, deluxe leather or deluxe
    12  fabric upholstery, deluxe wheels or wheel covers, four doors and
    13  a wheel base of at least 109 inches long that are manufactured
    14  or subsequently modified so they have a physical configuration
    15  and accessory features that are not considered as being
    16  ordinary, standard, or commonplace in lower to moderately lower
    17  priced vehicles and afford patrons a higher level of service and
    18  comfort than are ordinarily available in call or demand.

    20     Section 2.  Section 1103 of Title 66 is amended by adding a
    21  subsection to read:
    22  § 1103.  Procedure to obtain certificates of public convenience.

    24     (f)  Limousines service.--A certificate of public convenience
    25  to provide nonscheduled common carrier services rendered in
    26  luxury-type vehicles on an exclusive basis shall be granted by
    27  order of the commission without proof of the need for the
    28  service if the commission finds or determines that the applicant
    29  is capable of providing dependable limousine service to the
    30  public according to the rules and regulations of the commission.

     1     Section 3.  All acts and parts of acts are repealed insofar
     2  as they are inconsistent with this act.
     3     Section 4.  This act shall take effect in 60 days.
