                                     AN ACT

     1  Providing local choice for fluoridation of public water.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Short title.
     5     This act shall be known and may be cited as the Fluoridation
     6  Choice Act.
     7  Section 2.  Purpose.
     8     It is the purpose of this act to allow municipalities and
     9  public water authorities the option of removing fluoride or
    10  fluoridation systems from public water supplies in this
    11  Commonwealth.
    12  Section 3.  Local fluoridation option.
    13     Notwithstanding any other law, a municipality or public water
    14  authority may remove an existing water fluoridation system from
    15  a public water system.
    16  Section 4.  Notification.
    17     At least 60 days prior to taking action, a municipality or

     1  public water authority which intends to cease adding fluoride to
     2  a public water supply must communicate its intent in writing to
     3  all customers served by that water supply and to the Department
     4  of Environmental Protection. The municipality or public water
     5  authority shall hold a public hearing on the proposal within 30
     6  days after notifying the public.
     7  Section 5.  Effective date.
     8     This act shall take effect in 60 days.
