                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for utility industry
     3     restructuring.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a chapter to read:
     8                             CHAPTER 20
     9                   UTILITY INDUSTRY RESTRUCTURING
    10  Sec.
    11  2001.  Applicability.
    12  2002.  Mandatory rate reduction.
    13  § 2001.  Applicability.
    14     In addition to any other specific requirements contained in
    15  this title, the provisions of this chapter shall apply to the
    16  restructuring or deregulation of any public utility industry.
    17  § 2002.  Mandatory rate reduction.

     1     In the event a public utility realizes savings because of:
     2         (1)  the sale, purchase or transfer of one or more
     3     Pennsylvania divisions, business units or facilities;
     4         (2)  merger with another entity; or
     5         (3)  reductions in work force as a result of paragraph
     6     (1) or (2) or the general restructuring or deregulation of
     7     the public utility industry,
     8  then 50% of the savings realized shall accrue to the benefit of
     9  the customers of the public utility in the form of reductions in
    10  rates charged.
    11     Section 2.  This act shall take effect in 60 days.
