AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, prohibiting railroads from operating
3 railroad locomotives in reverse in certain instances.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 66 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 2710. Operating railroad locomotives in reverse.
9 (a) General rule.--No railroad operating in this
10 Commonwealth may operate any railroad locomotive in reverse or
11 backup position on any main line or lateral line, unless one of
12 the following applies:
13 (1) When an emergency exists.
14 (2) While performing switching operations.
15 (3) Where the railroad locomotive is solely engaged in
16 the transportation of passengers for tourist or public
17 entertainment purposes.
1 (b) Penalty.--Any railroad that violates this section shall
2 be subject to a fine of $1,000 for each violation.
3 (c) Regulation.--The commission shall promulgate the rules
4 and regulations necessary for the implementation of this
5 section.
6 (d) Enforcement.--The commission shall enforce this section
7 and may issue orders as may be proper to require compliance with
8 this section.
9 Section 2. This act shall take effect in 60 days.
