AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," providing for exclusion of abortion 12 coverage for health care and disability insurance. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 16 as The Insurance Company Law of 1921, is amended by adding a
1 section to read: 2 Section 633.1. Abortion Coverage Exclusion.--(a) All 3 insurers who make available individual or group health care and 4 disability insurance policies in this Commonwealth and who wish 5 to cover abortion services shall provide all insureds with an 6 express option to exclude coverage for each of the following: 7 (1) All abortion services except those necessary to avert 8 the death of the pregnant woman. 9 (2) All abortion services except those necessary to avert 10 the death of the pregnant woman or where the pregnancy is the 11 result of rape or incest. 12 (b) For group policies, the option of exclusion of coverage 13 under clause (1) of subsection (a) shall also be made available 14 to each individual insured who objects to abortion on moral or 15 religious grounds. 16 (c) Notice of the options for exclusion of abortion coverage 17 provided for in this section shall be printed on the application 18 form and on the insurance policy in sixteen-point boldface 19 print. Every insurance policy that contains an exclusion of 20 coverage for abortion services shall expressly state that such 21 coverage is excluded. Every insurance policy that does not 22 contain an exclusion for abortion coverage shall expressly state 23 that abortion services are covered. 24 (d) This section shall apply to all policies of health care 25 and disability insurance entered into or renewed on or after the 26 effective date of this section. 27 Section 2.
